i was in my lane he was besides me i had enough space infront of me he went ahead and feel the space infront of my car now in couple of seconds... he was going to east on oneway now his car is facinf north south i pull my all breakes and put my car in PARKING still it was so snowy...so i can even see my car sliding towards his car and my car hit his side bonete

He put his car sideways in front of oncoming traffic, he's got to be at fault.
But, the insurance companies will decide among themselves.
Yeah, you hit a weak part of his car with a strong part of yours -- good move on your part, I'd say! |

If you are in your lane it just depends one where the other car was.
If the other car was driving infront of you and went sidways all of a sudden and then you hit him, the fault would probably be 50/50 or 70/30 or something along those lines, because you should have been far enough back to be able to stop in a safe manner.
If the other car was in the other lane and was oncoming traffic, and became sidways into your lane, then you are not at all at fault because it was something you wouldn't have been able to anticipate. And the other driver did not keep their car in their own lane. |
