I was on a single carriage road and overtook on the left. Car coming from opposite and turning right was flashed in and I hit it. Their insurance say road was too narrow to overtake on left. I say not - who is right? Additional Details I forgot to say I was overtaking on the left as there was a queue of stationary traffic waiting to turn right.

In the UK you can only overtake on the left on a one way system. If the car you were passing was stationary, waiting to turn right and had moved into the centre, then you are probably ok as long as you were in your lane when the bump occurred. If the other car was then in your lane they are at fault and you are not supposed to take any notice of flashing headlights. |

Single carriageway should give you a clue: Unless there are separate lane markings for straight ahead & right turn, you are very much in the wrong.
The other car was also in the wrong. If they have admitted to turning because they were flashed by another car, the claim may just go 50/50: You should assume a vehicle is flashing it's lights only to warn you of it's presence, not as a signal to proceed.
I think I know the exact scenario: You were on a single carriageway road approaching a crossroads or a staggered junction. A car or cars in front were stationary, waiting to turn right. An oncoming car was turning right across the front of your car & hit you.
As I said, if there is a dedicated right turn lane & you are in the left hand, straight ahead lane, then you have right of way assuming there are no junction markings across the road you're on. If you're just 'nipping up the inside' of cars waiting to turn right, then you're at fault, but you may be able to wangle a 50/50 claim. |

If you could see ahead of you and could see the other car waiting to turn, you should not have been overtaking, you should have dropped your speed and pulled back behind the slower car.
You are at fault here. Also - I don't know where you are from but in the UK you are not allowed to overtake on the left. |

overtaking? or passing? if you were passing stationary traffic then then you and the other driver are at fault . you as you need to drive to withing a safe stopping speed etc so as not to hit any other traffic or persons and he as he should not have turned across your path while you were moving. best outcome 50 -50.
it will be normal for th Other insurance company to try and get all costs back form you. did you get any witnesses ? was the road marked a Two lane? and so on all have contributory factors which affect the eventual outcome. |

You took the risk of driving through a narrow gap, you misjudged the size of the gap, and hit a stationary car. Which therefore, by default, makes you at fault. Sorry. |

Technically two people were in the wrong that day. You because you are not allowed to overtake on the left hand side unless the traffic on the right hand lane is slower moving eg on a motorway. Second the car you crashed into because cars are not suppose to accept a flash and wait until it is clear to turn.
As it was a single carriageway and there was no turning lane for the person in front to get into to turn, you should have waited for the road to be clear before you carried on, therefore, it is your fault and either you or your insurance have to pay for the damages. |
