I am just a bit confused & need help. A few weeks ago I was crossing at a cross walk, and a driver ran a red light and hit me! She said she was changing her radio station. I was lucky enough to jump back so I got hit in the knee & her mirror hit me in the stomach & broke off! I had to stay home an entire week from work & school because of the pain.
Her Insurance company is trying to get me to settle for $1500? Everyone is telling me this is ridiculous, because I am not better yet, my knee still hurts & I still have crazy pains in my stomach. Please tell me what you guys think? Should I go to court or just take the $1500?

Did you go to the doctor? Are you treating for injuries? Were you taken by ambulance?
All of this happened a few weeks ago, seems odd they're offering settlement already unless you haven't seen a doctor for your injuries. Any type of gap you create by not treating is telling them you don't need it.
You have 2 years to settle a Bodily Injury claim with them, but if your not doing anything about your 'injuries' they're not going to offer any more. |

DO NOT TAKE THE MONEY!!!!!! Go to court, you are entitled to more like 25,000 to 50,000, maybe more. Pedestrians have the right of way and she admitted fault. That was a mistake on her part. If you don't go to court, your a fool. Any accident lawyer will jump on this. Payday for them and you. Call a lawyer first and foremost. |

Do not even think of settling for months. You need to wait to see if you have any other problems. They will try to intimidate you into settling. Do not listen to their bull. They are paid more if they get a low settlement. Wait! Time is on your side! They will end up offering more as time goes on. You will not need to go to court. That is the last thing that they would want. A lawyer will take half of any settlement. Try to do it yourself. |

Unless you have a record of trying to scam insurance companies, get an attorney and go to court or try to settle, but not for just $1500. Add another two or three zeros and you're getting close. |

Get a lawyer and get them to increase the settlement. A decent lawyer may only cost you $500 to get a decent settlement. However if you go to court and lose it will cost 1,000's in legal fees. So if you do go to court find a lawyer that won't charge if you lose. |
