mva accident not my fault 60 miles and hour interstate sideswiped me spun me out like 4 times it was raining he was cited for unsafe lanechange. I went to emergency room treated for a concussion cervical sprain and lower back sprain. 2 days later I had just gotten out of the dentist for a check up right before accident. 2 front teeth were knocked loose will need to tighted up over a month or two have to go in for mri's next week so far I have had to go the the er and dentist 2 and chiropractors 4 times a week for a month my chiro says I at least need another four months for my back shoulder is a different story... what kind of settlement am I looking at they fixed my car $4600 my med bills are up too 7,000 right now it has only been a month I cant work because I work in construction and I was paid under the table so I can't claim lost wages I need money and need to get back to work this is killing me what would be a good settlement range?

I am in the exact same situation and I was pregnant during the accident. It was two years ago last August and they still have not settled. My med bills were well over $10,000 and I have to have a knee replacement. I know how hard it is not to be able to do anything. There is a place called Oasis that will lend you money on an upcoming settlement but they rob you with the interest. I had no choice because I didn't have medical insurance and had to have the surgery. The other peoples insurance will drag this out as long as they can. I am taking them to court in Sept. which will be a little over three years since the accident. It is really hard, and your right about working under the table because I used to baby sit and the wouldn't give me a dime. I would say if you have not got an attorney yet get one, and expect A BUNCH of low ball offers. I hope everything works out okay, but it is a longand very hard road.

Rule of thumb is three times your medicals (plus wage loss) is what you ask for, they offer two, and you settle at 2.5. However, given how serious your injuries are, including the potential need for surgery, you should have a lawyer. They can get you more money and move the case along faster. If you are in a state with PIP (personal injury protection) on your insurance, they should pay you for your lost work, if your employer is willing to say that you worked for them.

You shouldn't settle until you are done treating and you k now how bad it is. Apply for state benefits in the meantime (food stamps, etc.) That's why you pay taxes.

Do NOT get a loan against your settlement, you have to pay double or more back and you end up with nothing. An attorney might have ideas on helping you get by in the meantime. See if you can go back to light work of some kind, maybe a desk job, or something light on the construction site. (If there is such a thing.)

Libraryanna's answer is the best in terms of finding out what a settlement range is, but you really must contact a personal injury lawyer in your state, or the state where the accident occurred, ASAP to make sure you haven't missed any claim filing deadlines. Find your state bar association via Google and go from there.

A personal injury attorney should listen FOR FREE to the particulars of your situation to determine whether you have a case and should also be willing to explain what benefits you can file for to keep your head above water in the meantime. Don't pay anything to the lawyer up front, DON'T take out a loan, and expect that if you go to court and win, the attorney will get 30% of your settlement.
