A truck going about 40miles an hour slammed my car's passenger side. I was going aroun 25-30. He crossed a red light. Both cars were towed at the scene. My car was totalled and my insurance is issuing a check for the car. How about my not so obvious injuries? I';ve hired a lawyer but would not tell me a detail of this kind of cases. There';s no broken bones or surgery required. Next day, I was drowsy, couldn';t focus, nausea, and slept a lot. My back and neck are mildly painful. Will see a doctor for that. Cat scan shows no damage in brain. I can';t still focus on writing a paper though. Doc said it will take few weeks to get back to normal. Is it even worthwhile to continue with a lawyer. I can function with few medications but not same as pre-accident obviously. What does anyone get in this kind of case from the other insurance company? Any real life example? Thanks.

what u can recover depends on negligence of other party, any contributory negligence on your part and nature and extent of injury..go to a good doc and follow his or her instructions.take what ever tests are recommended, and see how you progress. If you are still not satisfied get a second opinion from some doc who deals with type of compliants you have..any potential recovery assuming negligence is based on amount of reasonable medical bills, lost work time and temporary or permanent loss of the ability to physically enjoy life and return to normal activities...an old rule of thumb in liberal jurisdictions was about 3x the amounts of med bills plus lost time..in most areas soft tissue type injuries such as you describe now bring less than that unless you have strong support from treating doc..chiropatric treatment is harder to justify in most areas..good luck and hope u recover quickly and completely |

You don't say what state this loss occurred in. The threshold requirements vary from state to state. In some states in order to pursue a claim, your injury must be serious. The definition of serious also varies. In other states, you must meet a monetary threshold. Other states, are verbal. You submit medical bills/records and the adjuster evaluates the claim.
I don't think you need an attorney, but that is your choice. If you are tort eligible, your claim will be evaluated based on the nature and extent of your injury, disability, treatment and permanency if any. Any outstanding medical expenses/lost wages will be included. No settlement will be reached until you have stopped treating.
Typical soft tissue injury claim in say CT, with 12 weeks of chiro/pt treatment will get you about $3600-$4800 plus medicals/lost wages. |
