We got into an accident back in July 2008. It is of course March 2009 and we just received notice of 5000 dollars due for car repairs for the person we hit. We unfortunately didnt have a chance to get auto insurance yet and isnt his insurance company supposed to pay for it? And why are we just now being notified that we are due for this when its been months ago?

Did you have insurance when the accident occurred? If so, they should still cover it. If you didn't, you owe the money if you were at fault. You can't get insurance after the fact. The delay was probably caused by an investigation, the his insurance company would cover his damage, but have every right to come after you for their loss if you were at fault.
It is irresponsible to drive without insurance, and illegal in most places. If you are still driving without it, get it ASAP, but that won't help you on this situation, you might have to work out some sort of payment plan with them if you don't have the money. Unless you want to try hiring a lawyer to fight them, there's no way out of it.
I hope you learned your lesson and don't drive uninsured in the future. |

first off, you have 18 months from the time of an accident to report any further injuries or damage in most states. and if you got in an accident, most times your insurance will pay for their costs and theirs will pay for yours.
and shame on you for driving without insurance |
