Just before new year, sitting stationary at a roundabout, old guy bashed into back of me. Exchanged details and went through the insurance. Nearly 4 months on...and my insurance company is still chasing liability. Meanwhile, my premium was due for renewal at end of Jan and that has gone up and my insurance company tell me they have problems with the other insurers as they don't answer their phones. They tell me they're sending out letters every 2 weeks and are trying to phone them. I don't think this is enough, especially after all this time.
Basically, I'm being held over a barrel. I'll bet the old guy has got his car fixed now, but meanwhile even though I've done nothing wrong, I'm paying out more money and still have rear damage to my car!! I'm getting really sick of it, especially as I need to sell the car soon. It's completely ridiculous.
Please wait for rest.... Additional Details The only way I can get it fixed right now is by paying my excess, which I refuse to do. I pay my excess, my insurance company fix the car and then claim from other company, but with that, they could contest liability (even though it's bloody obvious - I've got rear damage, he had frontal damage and I was stationary at a roundabout) and I may not get my money back. Or wait.
I'm being held over a barrel and I've done nothing wrong! I'm going to go to citizen's advice and see what they say, but was wondering if anyone knew where I stand on this matter?

I would suggest that it is time the insurance issued proceedings against he other driver. I think you ought to get your insurance to repair the car and pay your excess which will be recoverable from the other driver. i would make this point to you. If you have not had your car repaired and the excess you have no loss. Hard but true, so help yourself a little and that will give the insurance company something to work with ie a cash figure |

unfortunately your premium will rise after a non fault accident. they call it no claim not no blame. we were rear ended in 2000 and we only got a full payout of excess and car hire cost in late 2002 best speak to the cab and if you have his details still the other driver.

If you have full comp then your insurers can be made to pay for the repairs. They of course can charge the excess and deny NCB at renewal until the other driver coughs up. As far as you are concerned it's the other driver who owes you money, his dealings with his insurance are his concern. You might have to initiate or threaten court action to move things along. Whatever you do keep your insurers in the loop. If you pay for the repairs or part pay then interest can be charged on the money until it is recovered |

Take out a personal injury lawyer for the injuries you suffered,
get your car fixed and change you insurance provider asap.
If you are rear-ended, call the police to the scene, this will help with your case for the insurers, and they may take legal action against the other driver, he was clearly driving dangerously.
I had a very simular incident, even though it wasn't my fault my premium went up over £600 for the next year. So I politly told my insurance company to kiss my *** and cancelled.
My new insurance was £400 cheeper than my insurance before the acident.
There is plenty of choice of insurers, just remind your current company they are to provide you with a service, if they can do that you will change.
Write a letter of complaint to their complaints dept and to their regulators.
You could even get a soliciter to look into them.
When it's sorted, change insurers anyway for messing you about.

Well, what would you have your insurer DO? Go to the other company and hold a gun to their head and make them pay? Here in the U.S. we have a right to NOT make a claim with our insurer; in other words one can pay the other person out-of-pocket if they want and there is NO law that states that they have to file a claim their company after an accident. If you don't report a claim the company CANNOT process and make settlement payments to anyone. many times people simply do not report claims with their insurer and the other company has to sue the person in order to recover the costs of the claim. I suggest you use your own insurance company. At least that way they will be able to subrogate against the other party -- which is usually enough to make them file a claim at that time.
