Question about my car title.?

My ex husband signed over the title to my car to me. I never had a chance to register it because it would cost me almost $300 to have it transferred from the state of OK. I'm now selling the car and still have the title that he signed, I signed and was notarized. My question is, can I sign over the title to the new owner even though I never got it registered? If not what can I do? The title is mine and there is a section for another title transfer so I didn't know if it mattered.

The car is unregistered because I can't afford to pay the 300 out of pocket. I told the buyers I would knock that amount off of the price since they will have to do the registration. They are fine with it. No the car is not stolen. The title was transfered to me by my ex husband when I moved.

Granted, I live in Massachusetts, but hopefully you'll get an idea. If you where in that senerio here:
You marked up the title, so now your ex would have to order a new one; $25 and 4- 6 week wait.
He get's the new title, and signs over to you. You go to the Registry, fill out application for Title; $50 + Sales tax on value (unless he signs gift transfer form) 6 - 8 week wait.
You get title in your name, finally sign over to buyers (if they haven't found something else in the mean time.) You forget to make copies of the paperwork. 2 months later, get excise tax bill; $25 per $1000 of value.

No, only dealers can "jump" title and move it without having the title transferred to them and registering the car. You will need to take the title to the DMV and transfer it into your name alone, and pay past registration fees, and if you waited more than 30 days to do the transfer there may be a fine also. Otherwise the new owner will not be able to transfer title and register the car. Since you were willing to take $300 off the price, leave it at the full price but take some of the money you will get for selling it, and take care of the title transfer and registration.

NO! You cannot sell a car that is not yours legally. If you do as you are proposing, it is called "jumping the title" and is illegal. Regarding the $300.00 in fees: If you were still married to him when he signed over the title to you, there would be no sales tax due because that is waived on transactions between family members. The only fees there would be would be a fee for a new title, etc. Check with your DMV because even if the transfer was made after the divorce there still may be a sales tax exemption available for you. Do it legally or it will come back to haunt you.
