if there was ice on the road and your car sweverd onto the other side of the road and crashed into another car, whose fault would this be? p.s neither car would be speeding, or driving dangerously. thanks

Many different scenarios to this question. In my dealings with this type of claim, if there was no report of driving unsafe or speeding and black ice was involved it should be considered a no fault claim, yet your carrier should cover the vehicle that was damaged. |

The one that lost control on the ice is at fault.
Reasons: 1. failing to maintain control of their vehicle, 2. driving too fast for conditions.
The speed limit is for when road conditions are ideal. It does not mean it's ok to go that fast when the roads are wet, icy or traffic is too heavy. You have to reduce your speed to accommodate the road conditions. |

The car that lost control would be at fault because the driver was not mantaining control of their car because they were traveling too fast for the icy conditions. |

In hazardous weather you need to drive accordingly, so if your car slid because you were not driving safe enough on ice, even if it is at the regular speed limit, it would be your fault. |

It is your fault for failing to maintain control of the vehicle, The police may or may not ticket, but the insurance company will rule it an at-fault accident, the fault of the vehicle that left the proper lane. |

It's Whoever Was Swerving on the ice road
because....
1.) It wasnt going slow enough...if it went slow it wouldn't have probrally swerve everywhere.
2.) Wasn't Able To Maintain/Control The Car...
Besides if there was icy road..it would've been blocked or a sign said "Go Very Slow" or something
