myself and my partner where involved in a road traffic accident he was driving and both myself and his brother both got seriously injured. there is no way of telling how we hit the tree, no skid marks and there is nothing wrong with the car. can the police prosocute him and what could happen also the insurance are trying to prosocute him aswell what can they do.

Come on!!!! these things don't just happen, there is always a cause and usually that is driving error.
Why are the insurance trying to prosecute? The only reason they would do so would be if they believed that the person was trying to make a fraudulent claim.
The police would prosecute for a driving offence if they believed there was one.
If you hit a tree and there are no faults on the car then the driver is 100% at fault.

The Police will only prosecute if they have evidence that the accident was the result of careless or dangerous driving.
If the insurance are trying to bring court action they suspect that he has not told the truth when he made the claim. |

Sounds like he was driving without due care and attention. He was probably breathalysed so a lot will depend on the result of that. |

Get the car thoroughly inspected e.g. brakes, steering and your partners eye sight, general health. Did he use the mobile phone? Did you distract him? Does he remember anything? Do you? An accident is one thing, a total blessed mystery is another. |

Oh come on. A car doesn't just hit a tree for no reason.
A reason will be found and it's likely your partner will be prosecuted if the fault doesn't lie with the car. |

On 3 occasions I have been one of several vehicles hit by another driver who has clearly made some sort of error.
In all 3 cases Police declined to take further action.
They will investigate to see if there is a clear case of an offence being committed but if it is not clear cut and no one is pressing them for any other reason.
You say that "the insurance are trying to prosecute him" - who's insurance? what do they say he has done wrong?
Methinks there is more to this than you are telling us. |

you could draw on similar accidents were two/ 3 police cars have left the road one leading to a fatal injury of someone stood at a bus stop and others leading to fatals , it is not uncommon and police claimed a defence of some kind . The police officer didn't receive a hefty fine or punishment were there was a death . EDIT ahhh thanks for the thumbs down much appreciated . |
