Should I let my son have his car back?
Find answers to your legal question.

Should I let my son have his car back?

In 2 weeks my 19 year old son will have his liscence reinstated from a DUI, and later an underage drinking charge. He has been living with his mother, we divorced 14 years ago. I have his car at my shop, and it is in my name, and under my insurance. He dropped out of highschool, and has been fired from his last 2 jobs. The DUI has cost me $3000. and I can't afford to go through that again. He won't be able to get his own insurance if I put the car in his name. He claims he can't get a job with out a car, because they live in the country where there is no work. Should I take the chance, am I liable if he does harm to some one with the car?

If you leave the car in your name, you are liable just as much as he is. If he causes damage that exceeds you liability limits, you could lose everything. You will be sued as the owner of the vehicle and allowing him to use the car (especially with his driving record - a lawyer would be all over that).
Put the car in his name, let him pay for everything. If you still want to help him out, have the insurance billed to you (but in HIS name) but then once he gets a job, be sure he pays you back. Sounds like he is not a very responsible person. I have a feeling he may very well go without insurance if given the chance. I would also have him start paying you back for the DUI costs. He did it not you, he should be responsible to pay for it. He needs to be responsible for his actions & unless and until he pays for it, he will keep up the same way he is now, why should he change? He has no incentive to.

I'd sell the car and wouldn't lose any sleep over it. He won't learn a lesson if you let him have it back. Maybe the next time he kills somebody in that car while driving drunk.

Do NOT let him drive a car in your name!! As the vehicle owner, you are liable for any damage he causes while driving your car. If he can not afford insurance on his own, then he is going to have to find alternative transportation. If he kills someone, you could loose everything that you have or ever hope to have!!!!

It is time for some tough love. He is 19 years old, in trouble with the law, a high school dropout and has a poor work history, and you think he should get a car for free?????????

Tell him that you are finished bailing him out of problems. Sell the car and use that money to pay part of the cost of his DUI defense. Give him an incentive. You may want to tell him that if he gets his GED within 6 months, you will consider helping him get another car. There are options for him, but he needs to be willing to work. He may consider a Job Corps training center, where he can learn a trade and and get his high school degree.

As long as you keep letting him get away without growing up, he will never become a responsible adult!

Is he in AA?

There is a time when we must stop supporting bad behavior...he like anyone else must understand real people don't act like this..If you give in this time there will be consequences....if wish they were good....but most likely not.

Suggestion.....drop into an AA Alon meeting....you'll find a lot of other people in the same situation.

You know the consequences...financial and moral....what happens if he goes straight...your a hero....what happens if he kills someone....your a murder..

Good Luck...

He is not underage, so he would be responsible, if the vehicle is in his name. If he can not afford the insurance himself give him enough to pay for the first two months (on his own policy, long enough for him to find a job). Then have him pick up the payments on his insurance policy. Also I would expect him to pay for the vehicle.

If the car is in his name, or yours you are liable till the age of 21.Some states you are liable till the age of 25. If you think of doing this are you ready to be sued for everything that you worked for be taken away ? Do you think you can handle the stress of knowing your son killed another motorist or even their whole family ?What you should do is get him a bicycle or ride the school bus and let him finish his education let him go to rehab program , attend a couple of funerals of people killed by other D.U.I. drivers . Then after completion of school and rehab do you think he responsible enough to get behind the wheel. Remember to tell him that driving a car is not a right it is a previlige that can be removed from him forever by the state if they find the need to do so.

looks like to me he dont have a car and really you think he will stop drinking at 19...... he is grwo and he should and did make the choice.... sell your car buy him a bike its what he needs

no name
Catch 22, huh?

Have him do stuff around the house to earn the car. Isn't there a deck you have been meaning to repair or some house painting that needs to be done?

Put the car in his name and let him deal with the rest.
It is time he grew up. You should quit bailing him out and let him suffer his own consequences.

Good luck to you...I have two children approaching this age.

Oh...not sure about the liability but I would think if the car is in your name you could suffer some liability. Check with your insurance company.
