So I bought a car with a lien on it.....?

Okay so.
I bought a car from my friend, and his mom had sold it to him and she had put a lien on it at the time of that sale...
The lien is still on it and I can't put the title in my name...
If I go to her and ask her to sign to release the lien, can she repossess the car if her son wasn't supposed to sell it?

Well I didn't notice the lien until the lady at the tag office told me that I couldn't get a tag or transfer the title.

A car cannot be sold until the lien is satisfied. You do not legally own the car. You will have to satisfy the lien with the lien holder or return the car to the lien holder.

By the way, doesn't matter whose name the car/title is in. The lien holder owns the car until a lien release has been filed.

Your friend sold you a car he couldn't legally sell. Either his mother has to release the lien, or your friend takes the car back and refunds your money.

if the lien has not been satisfied yet, then you have to pay the lien off first before that car can be yours otherwise your friend's ma still entitled to that car

Yes, she can reposess the car. Then you have to file charges against your friend, and press charges and sue him to get your money back.

It's not your car, if he didn't give you a clear title.

see mom she has to issue a letter that the lien is satisfied and she no longer has an interest in this car. i think you mistakenly identified that guy as your friend/ he knew you dont forget details like that/ a hundred says he does not have money. just to shake up him and his mom mention that he can be charged with fraud and fraud is a felony/ you cant go around misrepresenting that objects you have are yours when they are not. what about buying a bridge from me/ you can collect tolls and get a profit

You need the mother to sign the title releasing the lien.

If she refuses, call the police and have her son arrested for selling a car he couldnt legally sell.

The repo thing is iffy.

You have a bill of sale from her son.

Its probably just a clerical issue but if not, you could end up out your money and the son arrested and end up owing you the money.

Most moms wouldnt want their son to go to jail.
