I sold my sportsbike for $3000 and put $200 on the bill of sale to reduce registration taxes. The guy wants his money back and said he was going to take me to court. Which would override, the bill of sale price ($3000), or the priced put on title ($200)?

The reason he wanted his money back is because the oil was milky, he tried to say the motor was blown, but the bike ran like a million dollars. I put on bill of sale engine runs, which if did, and he and I both signed it. He paid me in cash.

The bill of sale will override, because it is the binding contract.
If the two don't match, whoever is responsible for the discrepancy is going to be charged with fraud. |

If you did not guarantee the bike, he is out of luck. All used vehicles sold by private parties are as-is unless you stipulate a guarantee of condition. |

Why does he want his money back?
Do you offer refunds on bike sales?
most times it is buyer beware, all sales final.

The bill of sale would override the title. Both you and the buyer have defrauded your state by reporting the incorrect sell price. If it goes to court you will both be in trouble for that. |

Sounds like the bill of sale will hold up if you signed it. The lying about registration might put you in a tight spot. Just shut the dude up and get him his money back if you can. |

Did he sign the bill of sale knowing it said $200? If so, then that's probably all he'll get. He might be able to produce a copy of the check he wrote for $3000, but the remaining $2800 could have gone to some other fees he won't have documentation for. If he paid with cash, he's got no case. Personally, I don't think he would have a case anyway since most people know buying stuff like this means "All Sales Final." |
