Someone hit my car and is now refusing to pay! What can I do?

Ok I don't want to hear take him to small claims court, so please dont suggest that.

Here's what happened....

The guy hit my car in a parking lot, did not have insurance, did not have a license and begged us not to call the police because he didn't want to have his wife's truck taken away. He had a kid with him so we felt bad. We followed him to his house, verified all the info he gave us and spoke to his wife who also promised he would pay. We were in contact for a little while trying to get estimates and such but once he found out it was going to be $500 he stopped taking our calls. I waited two weeks then called him from my job (he didn't recognize the number) and when I asked to start paying maybe $20 buck a week or get some insurance now, he hung up on me. What can I do now? Can I make a police report? Back in california there's a Department of Motor Vehicle to file a report with who will in turn suspend his license and impound his vehicle if they find it on the street but I'm new to San Antonio and don't know what or where to call? Can someone please give me some info? or suggestions?

First, you could call the police. You're already in trouble for not reporting a property damage accident, but perhaps by being the first to get to the police, you can make that part go away.

Second, you could call your insurance company and have them subrogate the cost for you. (They pay you, and then they go after the guy to get the money.) Of course, if your deductable is more than the cost of the damage, that's not going to work.

Finally, look at it this way: you don't want to go to small claims court, your insurance company will be little help because of the small amount of damage, and this guy is clearly not planning to pay for the damage.

Your choices are few: go beat him up and take the money (he doesn't have it...), or just forget about it. Lesson learned.

Last thing: never, never NEVER leave the scene of an accident without filing a report.

I would file a police report and then if the authorities don't take care of the problem then I would go to this guy's house and beat the living crap out him, Yelling giv me my money!!!!! But if you didn't call the police the minute the accident happened then there is a good chance you won't get to see any of your money.

look you should just call the police and get them to deal with it , you have been more than helpfull and he has just thrown it back in your face!! i think you have given him his chance! If you still feel bad maybe text him and let him know what your plans are i might chance his mind, hope you sort it all out :)

Tell him he has 2 choices- start paying you for damages, or go to court.

If you want your money for damages, those are the only choices you have.

You should have called the police at the time of the accident. He knows it is your word against his word. You will have a hard time proving it. I think since you have all his information, you can place a lien on his property.

You can sue them, but without a police report to determine fault, you may get nothing. It may be too late this time, but always call the police after an accident no matter how small.

You learned a lesson, simple as that.

Even though this guy is the scum of society (not talking about not paying you, but driving without insurance? C'mon), I doubt that you have many legal options left.

I'm not saying that two wrongs make a right, but you could always say that he threatened you if you were to call the police on him since he didn't have insurance. Again, I don't recommend that, but you could always tell him that you are planning to do such a thing.

Manipulate that scum as he manipulated you if you want the money. I would recommend that you just be honest with the police and explain the whole situation. If they say you can go further, great. If not, just be thankful the damage wasn't worse.

Did you at least file a claim with "your" insurance? If not, try and do so. It may be too late. If you didn't file a police report at the time, and if you didn't/can't file a claim, you may be just plain screwed. Hindsight is 20/20.
