Someone hit my car and left a note. What do I do?
Find answers to your legal question.

Someone hit my car and left a note. What do I do?

Ohio. Neighbor hit my new car, left a note, and I called him. He offered to have me get an estimate and he'd write me a check, but I told him I'd rather go through his insurance company. It has been 7 hours since the accident and his insurance company has not called mine. I reported the accident to my company. So do I need to file a police report? How long should it take for his company to contact me?
Additional Details
1. I don't think it's true that he has the right either to pay me or go via insurance. I think he has to go through insurance if that's what I want.

2. He has already hit another of our cars, so I don't feel like being particularly nice.

3. Is it true that I have to contact his insurance company? Or do they contact me?

Its been 7 hours? Oh my! LOL sorry.

Ok so who knows if he even called his insurance. that could by why they haven't called you.

You have a right to mitigate your damages- by so you need to call his company and make sure the claim was filed.

Also file a police report- Always notify the police of an accident.

If worse comes to worse- file w/ your own company. You will have to pay your deductible but if your company can collect the money back from the other insurance, your deductible will be refunded to you.

Hope this helps

First do not call the police. They have more pressing issues than a girl that over reacted to something simple. No offense but you did. He hit your car and left you a note stating so, he in no way tried to deny it when you contacted him, he offered to pay you for the damages received once you provided him with an estimate. Which would have been quicker than dealing with his insurance.

His obligation is to pay for damages he caused. It is his right to chose whether he pays out of his pocket or lets his insurance company choose. Your insurance company will not get involved until the damages are not paid for and you have to file an uninsured motorist claim which I am sure will not be the case her.

The wreck was 7 hours ago and I assure you that you are not the only one in the US to have had a wreck recently and are dealing with the same company. Their first step is to protect their insured so they will contact him to get the scoop before you. This will probably take a day or two, then they will want estimates and information before cutting you the check for the damages. They may even want their claims adjuster to come out and take a look so all and all it will take a week or two. You could have had a check tom. if you would have gotten the nice guy an estimate and took it to him he would have stroked you a check.

Next time calm down take a breath and react to the situation. I am sure the damages were not great sa he wants to pay for it.

What you should do is find out what damage has been done and the cost of repair. Your neighbor has the right to pay you directly, and that is what he wanted to do. Once you know your costs, call him and tell him. If he pays you that amount, give him a receipt and it's over and done with. Go fix your car.

If you insist on going through insurance, just call his company and make a claim with them, again for the amount of your damage.

First of all, if he offered to pay, did you get an estimate of the damages? Its perfectly fair if he wants to pay out of his pocket since he probably has one too many claims already or doesn't want to have any on his record.
If you are going through his company because you don't trust his good will, then its best to have contacted the police for a police report that the insurance company needs as part of a claim. Why you reported to your company doesn't do anything unless you are filing a claim for uninsured motorist(then you get a claim on your record). His insurance company is not going to call your company; his insurance company is dealing with you(the claimant) and the insured(who now has a claim). You have to be the one to make the contact.

THAT IS SO HONEST OF HIM TO ADMIT TO HITTING YOUR CAR AND LEAVING A NOTE. YOU DON'T SEE THAT UP HERE IN NYC. BUT YOU SHOULDN'T HAVE CALLED THE INSURANCE COMPANY - EVEN THOUGH IT WASN'T YOUR FAULT, YOUR RATES WILL GO SKY HIGH. THIS HAPPENED TO MY EX HUBBY AND HE WAS PAYING A FORTUNE. TOO BAD YOU DIDN'T ASK THIS QUESTION BEFORE CONTACTING THE INSURANCE COMPANY. THAT'S WHY HE WAS SO HONEST AND LEFT THE NOTE OFFERING TO WORK IT OUT INSTEAD, BECAUSE HE PROBABLY KNOWS WHAT WILL HAPPEN.

I would most definitely file a police report if you are going to go through his insurance. if you don't it is going to be really hard to get the insurance company to cut you a check.

Call the police and get a police report! and I will sill get those estimates

I don't think you should have involved his insurance company. He probably wanted to pay you directly so his insurance wouldn't go up. Get your car repaired and get him to pay the bill.

Geez, chill out! As I write this, it has been 9 hours since you reported the loss to the other guy's insurance company. Do you know how many claims they receive in the course of a day? Most insurance company do have "Best Practices" and certain claims protocols. Generally, they have 24 hours to contact the other party(you) after an accident has been reported. If you do not hear back by tomorrow, call back then.

I would call the police and get a police report. Always get a police report.

Get a police report your insurance companies rep. will come out and file a report and take pictures then avise you what steps will be taken after that.
You have already contacted the insurance company so your neighbor's insurance will go up no matter what. By filing a police report he may get a moving volition. But, if the neighbor decides to not pay the police report will hold up in court. By not having the police report even with the insurance statement you may loose. So get the report.

always get a police report tha insurance needs it and if he dosnt pay u have proof but theres a stature of limitations that is only like 24hrs so yeah.

I wouldn't get the police involved just because its a neighbor, you still have to live next to the person. Give him sometime and if in a day or so you get no response try calling his ins. company. If that doesn't work talk to him, then call the police if you need to.
