I was parked on their road and their 16 year old daughter backed into my car. They left a note saying to come talk to them, and I did. I went to their house with the phone in my hands to call the cops, but they basically begged me to not file with insurance and promised to pay in full. I called them a few days later with updates on quotes and the mother told me "they changed their mind and only think they have to pay half." Can i still file with their insurance? I didn't call the cops yet, and I think it's actually two weeks now that I think about it. They hit a parked car! Don't they have to pay either way?
My plan is to go to them and say either they pay in full or I tell their insurance Co. that she hit my car and make sure her rates go up. Suggestions? HELP?

Ask them how they justify paying only 50%. If they do not pay you in full, contact their insurance company and file a claim. You will be paid in full. Depending on what state this loss occurred in, the statute of limitations for property damage claims is anywhere from 1 to 6 years.
You could always file a claim under your own Collision Coverage, and your insurance company will subrogate for what they paid plus your deductible(if it applies). Your rates will probably not be effected just because you file a claim. You were not at fault. I have been rearended numerous times, and my rates have never gone up. |

I would not contact them any more on it- they know you have that option and asked you not to use it and now are trying to back out on the responsibility. Call your insurance company tell them what happened - they may ask you to go ahead and file a report with the police. Then let your insurance company fix your car if it is her fault they will go after the other parties insurance company for payment. By doing this you are insured you don't get hosed by the ppl or their insurance and your rates should not go up- because it was not your fault. |

yeah if she hit your car, then its either they pay the full price, or you get their insurance company to fork out the cash. You shouldnt be paid half the money, unless you're asking for a rediculous amount compared to the damage done. So yeah i think you should do what you suggested you would do. |

It is never wise to settle on your own as you are now finding out. Call your insurance company and let them pursue this. A thorn might be that you didn't report this to the police. ALWAYS call the police and the insurance company.....

If you have their insurance information file a claim with their carrier. If you don't have their insurance information file a claim with your carrier. Do you have any of the details of your agreement in writing? If so you can submit that you either carrier. Get a police report ASAP. You have no liability in this loss but if there is no independent verification of this loss they can easily say that it just didn't happen. No matter how small the loss seems or even if the other person begs you not to, ALWAYS get the police report. Often what happens in situations like this is that people look at the damage and think its only going to cost a few hundred dollars and then you go and get an estimate and now it is a thousand dollars and they just can't pay it. |

I would call them one more time. That they will pay the full amount of the repairs. Remember the written statement is only good for 30 days. The cost could go up. If they do not want to pay the full amount, that it will be turned over to the insurance company. Give then a couple days to think about it. And to give you a call back. I would record this talk. If they do not call you back to give you full payment. Then call your agent and fill a claim against the girl that back into your car. I would tell your insurance agent a head of time. At what you are trying to do. He may give them a call on youe behave. I hope you kept the note. It can be used to get the claim cleared up fast. |
