Do you think that it would be best to go in front of a judge or jury? I do only have liability and no uninsured drivers thing, I have never gotten a ticket nor have I ever been in an accident and I am in my late 20s so this is aggrevating. I dont have enough money to get a lawyer, the car was in her husbands name, she is 25 her hubby 45 and it was his vehichle so I am sure I can sue him as well right? Please help! Thanks to all! Well she was the one driving the car and it is her husbands who knew there was no insurance on the car because it was cancelled back in 2007. So if she can not pay up then it should be her husbands fault for letting a person drive his uninsured car. At least that is what my insurance company said. To the person who posted one of the comments: the girl ran a red light and slammed dead into my car, when the cops came she stated she had a green light. On the police statement it states "unable to determine fault driver due to conflicting statements" however her statement states that I had a yellow light which she would never be able to see, and if I had yellow how did she, opposite traffic, have green? I am utterly confused how they were unable to determine that she was at fault, but this is the hand that I am dealt. From the comments I am guessing my best bet is to go in front of a jury instead of a judge. Anybody have any other helpful comments? Thanks SO much to all!

Yes, It would be best to go in front of a judge or jury. This way this problem will be handled properly and it will be resolved.

I would let the at fault driver's insurance do their job before you seek a lawyer. They would take a third of any settlement. Why would you want to sue her husband if he wasn't driving? |
