It's 3 points a "corner", so there were two defective tyres. Yes, your flatmate is being done for using it in that condition, and you too for "causing or permitting" him to use it in that condition. Unless you wish to claim he took it without your permission.
There's little to defend, unless you care to argue with the police view of the condition of the tyres, I'm afraid. |

afraid not he is liable for using the car with two illegal tyres and you are liable for allowing him to use the car with two illegal tyres,,no defence you should have known about the tyres when you let him use it,just as a transport manager who tells his driver to use a lorry,with dodgy tyres is guilty for "causing"his employee to use the vehicle,both are equal in guilt,
you are i feel a little wiser,ignorance of the law is no excuse,,if the dodgy tyres had caused a death no doubt you would be saying "i never meant that to happen,i am so sorry"too little too late, just like the potential "killers"who use mobile phones and sat navs etc etc while driving,time to pay the piper! |

If you knew about the tyres (you probably did) and lent him the car you are equally to blame. Your only way out is to add theft to the list of offences your mate has. |

I was in a similar position many years ago: Basically, you can't get out of this unless you have your flatmate prosecuted for taking without owner's consent (TWOC)
Just looking at your other answers: It's the driver's responsibility to check tyres (otherwise company car drivers wouldn't need to check tyres, lights, etc., ) but the issue here is that unless you specifically tell the police that your friend took the car without your consent, then legally you're complicit. |

were you in the car when it was stopped if you were then you will both get prosecuted.
it is the drivers responsibility to ensure that a vehicle is roadworthy as there is really no way to prove the tyres were illegal before your mate borrowed it , however if you were in the car at the time the police stopped you did you admit to knowing about the tyres and that is why,
bald tyres or not whoever was driving will get done, as for youself go see a solicitor you get a hours free advice. |

as far as i am aware after watching many police programs, it is the driveers responsibility. if you lent the car to your friend he should have checked it was safe to use on the road. i think it will just be your friend getting the points. |
