Totaled car, pawned title, no insurance?
|
Okay. My title has been pawned for a few months now. My car has been giving me major troubles since April, so I stopped driving it, and canceled my insurance and all (BAD choice!!). Anyways...recently I finally got it fixed, but at the time didn't have the money to get insurance. I decided not to drive it until I got it insured, but I had to run to the store. I got into an accident on the way, and the whole front end of my car is screwed. I have a big fine to pay, but the cop told me to go get insurance and take it to court to help me. Can you do that? Get insrance after the fact and use it to your advantage? What about my pawned title? Do I still have to pay it, or is the damaged car payment itself? I am no longer using it. I am getting a new car. Help?! Additional Details The car that I owned that get wrecked was paid in full. The other driver's car was not even scratched (funny, I know!).

As for the insurance, yes, just go get insurance and you'll be able to show proof when you go to court, they will likely reduce your fine for providing the proof of insurance. If you don't insure the car, and go to court, you'll pay the full fine, plus any other costs.
Regarding the pawned title.............Yes you still have to pay for the loan and will not receive the title until the debt is paid in full. I'm guessing interest rates on this loan are very high, poor decision, but it's already happened, so you must move on and learn from it. The damaged car is not payment by itself, the pawn was for an undamaged car, it doesn't make the loan go away, it just means that it's gonna cost you to fix the car, and you'll probably be sued by the people you wrecked into. Whether you choose to use the car, or purchase a new one, is up to you, but, you are digging a deeper hole in debt, and the old debts don't go away. Good luck. |

The idea of getting insurance after the fact is simply to impress the judge. That's all it'll do. If you're never going to drive the car again, you might want to show them you've got insurance on your new car instead. At least that way it doesn't cost you anything.
As far as the pawn shop goes, everybody else has given you good advice. I expect the pawn shop will require you to pay back what you owe them, and that you violated your agreement with them when you canceled your insurance. Whatever the case, you should always pay back what you borrow. If you don't you'll wind up a loser for the rest of your life, and you'll probably live a long long time.
The good news is wrecked cars are worth a lot of money. You'll be surprised when you start trying to get rid of it. |

You screwed up big time. It is illegal to get insurance "after the fact". It may be possible to just let it go to the place that holds the title. Read the paperwork you signed when you took the loan. As far as the fines...They will be your responsibility. |

No, you can't get insurance and have it pay to fix something that was damaged _before_ buying it. The pawned title?: read the contract you signed. It's a legal document that spells out what you agreed to when you took their money. |

no, after the fact will keep you from getting into more trouble, but you would have had to have insurance at the time of the wreck in order to save you money at the time of your court case. |

the cop is right, but it probably wont help you in court. as far as the title loan goes, look at the paperwork you got from the title place and see what it says in them about your situation. if it doesnt say anything, then i wouldnt pay it, but you risk getting sued for the money |

You didn't have insurance at the time of the accident, so it's uncovered. Getting insurance after the fact won't help you at all. You still owe whatever you borrowed on the car, they don't want it wrecked. The papers you signed for the loan contain a clause that you will keep the vehicle insured and in good repair, which you didn't so you are technically in default anyway. If you aren't using the car, save your money to get coverage on your new one. Go pay off the loan so you can get the title, then arrange to take it to the junk yard. Scrap metal prices are not bad at the moment. |

Actually you need to go and get at least the state min of insurance.. here in cali it is :
BI: 15,000/30,000
pd: 5,000
This is to help you in court to show that you are abiding laws. You can explain your case but you would still in the end need insurance before you go to court. The new insurance company will not pay for the damages that occurred prior to you purchasing insurance with them. You do have to pay the pawned title. Once you have taken care all of the legal fees you acquired you can get rid of the vehicle. Anything that occurs while the vehicle is your responsibility you must take care of.
When you purchase insurance get it on a monthly payment account so that you may cancel it and only pay the difference once you get rid of the vehicle. |

I'd get a bus pass and/or a bicycle.
Exactly what kind of help are you looking for?
Oh- you can get insurance, just not collision insurance. Get basic liability and hope that the judge doesn't look at the date range. |

if you get insurance now, it shows the judge that you are trying, but if he looks at the dates, he can still make the fine stick.
I don't know how pawn shops work, but I would go tell them that they can have the car, tell them what happened, and they might not bother to follow up, then they may take you to court to get the money back or they may just hurt your credit rating, but that will give you some time to save up money to deal with it. |

It sounds like you have made one bad choice after the other. You are going to be fined and probably lose your license for driving without insurance, and the lien holder is going to sue you for the value of the car.
Time to re think the path you are on.
Getting insurance after the fact will help nothing if your car is not drivable. It will just be more money you are throwing down a rat hole. Getting a new car without clearing up your old mess won't help either.
Get real here. |

I'm sure you got as really nice fine for driving uninsured!!!
Looks like your in deep on this one ...get a good lawyer for the court case your gonna have with the folks you hit .....so now your gonna pay to repair 2 cars!!!!
By the way if you stopped paying your insurance I'm sure the DMV will be sending you a fine soon as well unless you turned in the tags .
My advice....
Get a good pair of walking shoes.... |

NOPE, I SEE NO WAY OUT OF THIS AND PROVIDING INSURANCE AFTER THE FACT MAY MAKE THE JUDGE A LITTLE HAPPIER BUT NOT MUCH.
YOU WILL STILL HAVE TO PAY ANY AND ALL FINES AND ALSO PAY OFF THE PAWN SHOP BECAUSE SOMEONE WILL BE PUTTING A LIEN ON YOU AND OR YOUR PROPERTY. |
