UK ONLY: Had a car crash. Comprehensive insurance. When can I expect to receive a payout?

Three days ago I was driving along in my car when a van undertook me, pulled out, and hit my left hand side pushing me into the central reservation. It is only a £500 car and is obviously a write-off.
Also I got whiplash injuries, and will be off work for a week, and as I am self employed this means that I am down a week's money. I was insured full comp.

How long will I have to wait to receive a cheque to buy a replacement car, and money to cover lost earnings? Would this be paid by my own insurance company?

The accident was the fault of the other guy. But what if he disputes this? Would I have to go to court, and would it delay any repayments?

I had a accident a year ago same as yours no fault, I think it depends on your insurance company, I was paid out fully within 2 weeks! The injury pay out will be longer as they wait to see the extent of your injuries, Whiplash can take over 1 year to cure, I had physio etc, and then was awarded Â£1800.00 hope this helpsThe other insurance company should provide you with a courtecy car as you were full comp.

It is difficult to say. Some insurers drag their feet, and others are on the ball. As for your car, you have to wait until an engineer inspects it before it is written off.
As for a claim for whiplash or anything else, the insurers will want medical evidence from a doctor or consultant as to these injuries and the severity of them.
Therefore, I would guess it will take a couple of months to settle your claim as long as the other driver doesn't counter claim against you. Unless there are witnesses you can call on, he may well do this.

From your description his insurance Company will have to "admit" liability.

On such a low value car neither insurance company is going to be bothered "fighting" a small claim. Once your car is assessed you should get a prompt payment. If you think it is Â£500 value the payout will liable to be Â£400 as insurance companies use a low valuation rating!

If you try claiming for whiplash this could slow everything down as Insurance Companies are fed up with the compensation culture of people trying to claim for imaginary whiplash. So it could drag on for months as they will wait for medical assessments on you etc.

Obviously you are peeved as it sounds as if it ws not your fault but trying to profit from it (whiplash claim) could backfire on you if you want a prompt payment!

I was rear ended back Jan 08 and still waiting for a pay out.

Although I think it depends on the situation, the guy that rear ended me was not admitting liability even though I was stopped at traffic lights. My solicitor had to get heavy with his insurance.

However, my car was not a write off but still Â£1900 worth of damage.

The write off value that the insurance company provides is unlikely to be enough to buy another car.
As you are self-employed, they will argue about how much money you have lost. You will probably need to provide your accounts to substantiate this.
It could take months.

I had a simple case, it took 1 month to get the money for the written off car. My insurance paid me, they claimed off the other party.

Yeah, this can take a while. I had someone go into the back of me and i didnt get mine for a fair few months, just keep checking on them and whats going on, they won't rush these things......ever!! So if u pester them (not too much to annoy them) then they will/should keep on top of things.

when the insurance company have sorted it with the other party insurance. my friend had accident on a mini roundabout and it was nearly 15 months before she had any money back from insurance. so be prepared for a wait im afraid
