UK only, car accident not your fault?

on friday of last week, my daughter and i was hit by another car, totally his fault, my car was damaged, and my daughter and i are still suffering with whiplash, now i reported within an hour to my insurance company, the guy who did it still has not 6 days later, i was advised by my insurance to ring his and report it, but they cannot accept that, and would not even look into it, so i text him to do it, but he does not want to lose his no claims, now i have never had to make a claim does this mean if he does nothing i will have to loose my own no claim to get it repaired or pay for it myself, and why does no one from the insurance company give you a striaght answer, have any of you been through this and will it take months to sort out as thats the feeling i am getting,

I would have thought that if you got his insurance details at the time and passeed them on to your insurance company that was enough.

I think that was all I had to do, but it was a long time ago now.

Call the Police. You still may have time to report the accident.

He wants to have "no claims" on his insurance... well.. tough luck! Then he shouldn't have been involved in a collision. He needs to take responsibility for what he's done. If he doesn't - then its a police issue.

this is why you have insurance, get onto them and get tehm to sort it. you shouldnt have to run around chasing them.

Firstly, your insurance company will want everything wrapped up quick. Make damn sure they understand it wasn't your fault, you don't accept responsibility, and you expect them to do everything they can to help you.

Let the guy know that if he doesn't sort it out in 24hrs, you're calling the Police. Tell your insurance company the same. And his.

Whatever you do, keep the pressure on everyone involved to do what you want. Keep leaning on them until it's properly sorted, and make it clear you're not going to go away.

If it was his fault, he must pay. Tell the police what happened. You should have done so anyway if you were injured. If he will not pay up through his insurance then he must agree in writing - have this witnessed by a solicitor if possible - that he will pay all the resulting costs of repairs and injury compensation if there is any. I bet he's not even insured, the horrible man.

did you call the police when it happenned? if you did then call them and ask them to chase it up for you!

if he dosent report the accident to his insurance theres nothing you can do put pressure on your own insurance company to sort it out you didn't say what policy you have fully comp will pay out at no cost to you third party might not go to your local police tell them what happened may a call from them to the other party might change his way of thinking good luck

The attitude of his ins co. is typical and ridicolous. See a solicitor straight away for legal advice. Do it tomorrow.

this is what should happen you have reported it to your insurance its is your insurance companies responsibility to follow it through with the 3rd party your company should be getting in touch with his company. did you get all the 3rd parties insurance details i.e company he insured with? his full name and address? car reg? make and model?

get back in touch with your company and tell them it has been over a week and they need to be doing something about the 3rd party

you dont want to be using a no win no fee company you should already have a solicitor through your own company if you took the motor legal protection with your policy cover

I'm surprized the insurrance company told you to ring the bloke's insurance to report it, I mean what do we pay insurance for that is their job. I would recommend the local police if they say insurance sorts it then ring back your insurance and demand they do something and hand over the blokes details and his iinsurance - it's their job.

Are You Insured Fully Comprehensive ? If Not , The onus is on You To to Claim Damages against the other Drivers Insurance [They will Not admit any Liability] [have you or your daughter seeked any proffessional medical treatment?] if not , it may be difficult to prove at a later date ie.[When your both better]. It does seem you may not have the Legal protection cover required or your insurer would have advised and taken the necessary steps in providing legal and Medical facilities for you both. I Suggest you contact your Insurers and ask , If Your not [all is not lost] contact a legal team dealing with , they often quote free legal advice and will send their representative to see you .Good Luck to You Both , Take care & Keep Well

i think its now a call to the police and explain to them that as of yet he hasn't reported the matter to his insurance company.

REQUIREMENT BY LAW ALL PESONAL INJURIES MUST BE REPORTED,IT IS OFFENCE NOT REPORT SUCH CASES.

there are to aspects to your claim , your car and yourselves,your car will be dealt with by your insurance company who in turn will approach his whether he reports it or not.
Regarding your personal injuries if you have not seen a doctor do so ASAP and then you need to decide if you wish to make a personal injury claim against the other driver. If you do then contact your insurers as they may deal with that under your insurance or contact a specialist solicitor not an accident management company for advice.

when you have a crash strait away at the scene you have to call the police to geta claim for whiplash or at least take his number plate reg down and his insurance co.

as for the damage, i myself have just made a claim but im lucky because my 1yr no claim is with a different company than the one im claiming for so i wont loose it. as for you, you will loose it if they pay out, and if they pay out for the amount of the vehicle or declare it a cat c- they will automatically declare it a write off and will take your motor away.

if i was you it wouldnt be worth it-if the car didnt cost much buy another one for cheap or go scrap yard yourself and get the damage done yourself

Sounds likely the other party might not have been insured, and is still stalling. Yes, get the police involved. They can trace the owner through their records. Mind you, that doesn't immediately help your case. Perhaps contact the Citizens Advice Bureau to enquire about ways to get compensation. A legal approach might get the Insurance company listening!
