Uninsured driver hit my vehicle!?

An uninsured driver came right out into rush hour traffic and hit my vehicle. The police were called and the cop acted as if he didn't want to be bothered with the accident. The driver a 19 yr old girl said her mom let her hold the car. The cop ran her info and said she had insurance. After calling my insurance, I was told that the driver in fact never had insurance. The vehicle involved hasn't been insured for over 2 years. Obviously the cop just told me anything to get out of writing a police report. My insurance which covers Uninsured collision said that the actual owner hangs up the phone every time they call. I'm now stuck with a 500$ deductible and rental car fees, with my insurance rate possibly going up. I'm trying my hardest not to just drive to the owners house and just slaughter the vehicle. How can I possibly be repaid for all the trouble that some bad uninsured driver caused.

You should also have UMPD and Rental Car coverage. With UMPD you don't have to pay the deductible when you use your UM (Uninsured Motorist coverage). Rental Car coverage pays a portion of the daily cost of renting a car. Do you have a copy of the police report? If not, get one. It will show the REGISTERED OWNER, and the driver.The REGISTERED OWNER of the vehicle is LEGALLY responsible for your damages. The insurance MUST be in the name of the REGISTERED OWNER. Ask to speak to the officer that made the report. Ask him / her if the driver showed an insurance card. If not, how was the officer able to determine that the vehicle was insured on the date of the accident? Was the damage to your vehicle more than $750.00? In most States drivers MUST report any collision damage over $750.00 & ANY bodily injury to the DMV. Call the DMV & find out. If so, report it. You can bet the other party didn't & the DMV will suspend their registration. Also, ask the DMV to verify that the Registered Owner of the other vehicle has current insurance and if it was in force on the date of the accident. If you decide to go to small claims court, name BOTH the Registered owner and the driver. |

You'll pay the money but my insurance (state farm) went after the dirtball that hit my car uninsured--they sued him-he didn't pay for almost 2 yrs but when he went to buy a house the bank saw he had a judgement on his credit report-he paid and state farm reimbursed me the deductable I paid. You probably have to pay upfront your $500 deductable but get TOUGH with your ins. co--that's what you pay for and make sure they get the money out of the girl somehow. Just because she hangs up is no excuse-they can send her certified letters and take her to court too. Tell your ins. rep that you will report him/her to the state ins.licensing board if they don't follow though. |

the ONLY thing that you can do is to file a lawsuit. and go to your local police department and raise hell about no police report being made.the girl should have gotten a ticket also. |

Ive had similar experience.
, several years ago, I was pulling out station at a busy light area, another driver signaled me to come out, guy flew in from highway and fenders contacted and mine got his down his side. I was ticketed, I was in fault as insurance had lapsed. Anyway he got 3 estimates, and I paid a money order to him. He did call, I called back, he come to my house and I told him when I had enough I would mail it. It is the only accident I have ever had and I am fully insured now with AAA. |

welcome to the real world...Fair??? LOL..some ****** hits u and u pay...you can sue them in small claim for the 500 but even if they don't show up and u win good luck collecting...my sis won a judgment and the guy [who was living at moms} took off she never got paid...good luck man,,try not to go crazy and get yourself it deep doo doo |

First of all I have to say that many insurance companies are getting a bad rap for things. The whole your insurance is going to go up no matter what is sort of like your check is in the mail scenario. If you are insured with a good insurance company and you are not at fault for a loss then chances are pretty good that you will not receive a rate increase. Rates are affected if you are at fault. However there are times when this isn't the case. for instance this is not your first not at fualt accident and you have several others as well. this is a pattern that they will look at. also if you have many other claims then yes, your rates could be affected but this is a claims frequency issue and maybe they should go up. Unisured motorist is not a premium bearing policy. What that means is when you have a loss the portions of your policy that are affected is collission, Property damage, and Liability. Sometimes Comprehensive but not normally. If your rates do go up it could be just the fact that just like everything else, the economy is not good and rates are being affected in general and may not have anything at all to do with this particular accident.
As far as your deductible, your insurance will try to collect not only the money they paid out but your deductible as well. This could be a long time and chances are you may not ever see it. You can go to court to recoupe your deductible but make sure you stay in contact with your insurance company so you are not signing away any of their rights when you do this.
I know you feel like driving over there and doing this however I wouldn't recommend it. Just because they did you wrong, take the upper road and move on. Karma man, it WILL come back. |

If you have uninsured motorist coverage you most likely have U/M P/D deductible waiver as well. If so, then when its verified the other party was uninsured you should get your deductible back. |
