I had just left my house and a woman turning around between the median hit me.
We get out and assess the damage. She slyly convinces me that she will have her insurance cover it and theres no need to report it after I threatened to call the cops twice. We do, however, exchange contact information and our addresses. A security officer that patrols the neighborhood stops and witnesses that the lady agrees to be at fault. However, he didn't witness the actual accident.
I filed a claim with her insurance - US Agencies. It has been a week since the accident and she has yet to answer calls/report her side of the accident to the insurance company. Today, I finally got a hold of her spouse who said he would have her call today. I threatened a law suit if she did not call. I called a little later and finally got in contact with her. She said she called the insurance company and left a voicemail and hasnt heard back from the adjuster (which is true bc when I finally got a hold of the adjuster she let me know that she did receive the call and will call her back but they still have not been in contact yet). My question is, will I be receiving the amount for my damages if she has a suspended license? What if she never gets in contact with the insurance co? The insurance is in her spouses fathers name and she claims she is an insured driver.

If she has insurance you will get the right amount still but she will most likely be getting arrested for driving on the suspended license. |

Her status wouldn't affect whether you get paid. But in the future, if you are in an accident where there is damage, you'd better call the police and your insurance company. |

D has the better answer; you should report the accident to your company anyway; they can help you with getting compensation. Your company has experience and resources that you don't have, and you're actually required to report the accident to them, anyway. Also, if it turns out that she didn't have insurance for some reason, you'll be in position to claim under your Uninsured Motorist coverage, which you might not be if you didn't report it. |

why you didnt call the police is beyond comprehension/you always need police report/if she flips and says it was you /your toast/no report its you and her/forget the guy that didnt see the accident/in court he is a non witness/if i was the lady i would say to the judge /o dear i was so afraid by myself with the guy who just ran into me that i said anything just to get away from him/i think he may have been drinking/its your word against hers |
