I received a fixed penalty notice for driving other than in accordance with a driving licence. I promptly paid the penalty. I couldn't find the counterpart copy of my licence and therefore was unable to produce the licence within the statutory period, but did produce insueance and MOT as demanded by police. I later applied to DVLA for a new one. The police collected the ticket from me when I went to produce the other documents and I had forgotten the ticket number. A community police officer adviced for me to wait for the police to write me befor e I send off the new licence. I have waited till now but no letters. I enquired from the Central Driving offences who now tell me that my case would have to go to court. Can any one please advice me on possible defences I may have in law.

Your best bet is to go try a traffic lawyer. Check your local yellow pages or the internet and find one that is both reputable and will offer you a free consultation. |

As deacons says, apply for a replacement licence now. You should always do that as soon as you realise you've lost yours.
There are no legal defences to failure to produce, either you produce or you don't. You didn't.
These things can take time to rise to the top of the pile, it may have become lost, been discarded or may still be working its way through the system.
If it does go any further and you actually do wind up in court, it'll maybe help if you can apologise for not realising you'd lost yours and say you've now obtained a replacement.
Goes without saying, as I'm sure you know but others may not, that you should always keep both parts together - both parts together make up the licence. |

I had just the same problem as you and could not find the paper bit of my licence , they took me to court i explained the fact that i had mislaid it and applied for a new one which i did produce in court they dismissed the charge for me .and mine was not for any other offence either , just for none production of paper part of licence . and what a waste of court and public money that was . |

the police tent to forget a lot of minor things....and sometimes drop the case all together... you have 6 months to her from them, if not then they cant carry the matter any further. My genuine advice is to wait for them to contact you... but in the mean time send off for your new licence |
