I was in a wreck with an 80 year old, he pulled out in front of me and I tried to avoid him but still hit his car. The police sited him for failure to yield. His insurance company is not going to give me enough to cover repairs. Is there any way I can save my car, all that I want is to get it fixed, can I bring up the fact that his ability to drive is non existent? Will getting a lawyer help me or is there nothing a lawyer can do?
Any help is appreciated. The accident happened in Ohio.

The insurance company will send out an adjuster, who will look at your car, and they may send it to a body shop for further evaluation. If the cost of fixing your car exceeds the fair market value, they will total it, and there is nothing you can do to change that. Once they do, the car is theirs, they have bought it. You can sometimes buy it back for salvage value, but if you do you will be given a salvage title, and will have a hard time getting insurance coverage for it if you plan to keep driving it.
No, an attorney won't be able to help, nor will his ability to drive. They are apparently accepting liability regardless. |

The most that they are required to give you for damage to your car is EITHER the value of your car OR the cost of repairing it. If the cost of repairing it is more than its value, they are not required to have it repaired. However, you can buy another car with the money that they give you when they declare it totaled. |

I bought mine back from the insurance company for $250 and then had it repaired. The air bag had deployed and put it over their limits. It has been running well for at least 5 more years. Their settlement paid for the repairs including the airbag. |
