You call the claims adjuster tomorrow AM and ask her/him any questions you may have. They are all very busy so be patient and keep calling until you get her/him on the phone. If the adjuster cannot answer any question to your satisfaction then respectfully request a manager to explain it. I realize you have a ton of crap falling all around you right now but don't fret -- this happens about 10,000 times a day. It will work out.
P.S. -- you right not to sue. It only results in your lawyer getting 1/3 of your money.

Most of the answers above are pretty good.

1) Call your insurance company and report the accident. You could lose your license if you do not and they may cancel you for the same reason. Once you report it, they can provide guidance and help you with your questions.

2) In California you can take your car anywhere you want to have it repaired. The other persons adjuster will try to get the car repaired for as little as possible since it comes out of their operating budget. You should get a second estimate at least.

3) Injuries ? You MUST file paperwork.. or you will get a serious ticket and see #1).

4) Lost time and wages, and rental car and such.. you are entitled to some reasonable compensation talk to your agent.. then talk to THEIR agent.. but keep a lawyer in mind.

You have to take action.. it is YOUR life and such.. and you make your own Karma, dear.. not the other persons agent.

Do you have insurance yourself? If so, did you report it to your agent? He/she can tell you what to do. Is the other company going to pay the full amount of the repair? You should keep in contact with them and ask them any questions you can think of regarding your car.

Any questions you might have are best answered by the claims adjuster working on your case. Your own insurance company can also help in answering general questions you might have.

Any damage to vehicles over $500 requires a police report to be filed. That should be filed within 10 days of the accident. You may be entitled to a rental car so you should talk to the insurance agent about getting a rental car -- paid for by them. Were any tickets issued? Did you go to the hospital? Did you get any receipts--like from the car repair people? Check it out. You should probably be able to get a rental car paid for by their insurance company. If your car isn't fixed to your satisfaction, do not accept it. Be careful about signing off on the papers. You might want to check with your attorney. Your insurance company might help you settle this.
