Countersue. If your lane change was legal, countersue and get paid for the damages he made to your car and any medical bills.
And get insurance! |

In Canada usually if you are hit from behind the person in the back vehicle is charged with following too close . If you were stopped to turn and he was in the same lane then how was it an illegal lane change? That would mean he too made an illegal lane change would it not?you may get in trouble because of the insurance but I think you should seek legal counsel. |

I think when a driver drives into anything in front of him, he's going to be the one found to be at fault. But, you'd be crazy to try and get through this without a lawyer. You need to be defended and probably file a countersuit in that case, maybe file another claim or suit against the other driver, since you have no insurance company to handle things. You'll probably end up getting your car fixed and your legal expenses paid. Although, the fact that you were driving without insurance isn't going to help as far as the court system being friendly to you and the other driver's insurance company trying to take advantage of you. Get a GOOD lawyer. The other driver's insurance company has several of them... |

The burden of proof is on him. In most states, the person who does the rear ending is at fault, no matter what. Unless he has witnesses that will swear in court that what you were doing was illegal, he has nothing. |

If he sues you, you defend yourself. You'll have to get a lawyer What does the police report say? That'll be important.
One thing that doesn't make sense: You say "he wants to sue me because I don't have insurance". That would be a stupid reason to sue somebody. Normally, you sue them so that you can get free money /from/ the insurance company. |

pay up. you are in the wrong. not only for the accident but for not having insurance. face the consequences and don't make the same mistakes in the future. it is true that the other driver is also in the wrong for hitting you from the rear. it is possible that you can at least make it so that you both have to pay something or so that you don't have to pay quite as much - perhaps you can make it so that you only have to pay a fine for not having insurance. anyway, good luck. |

You need to get legal advice. I worked as a motor claims handler in England and if you are hit in the rear it is always the persons behind fault for not leaving enough room to brake in time.
Did you change lanes illegally? If not where is your damage. If it is in the middle of the rear of your vehicle then the other driver must be to blame. If the damage is to the side of the rear of your vehicle could it be that you did change lanes?
Were there any witnesses. Would a drawing of the area where the accident occurred make what occurred any clearer and show that a lane change was unlikely.
As you dont have an insurance company to do this work for you you need to gather as much evidence as you can for a lawyer to argue your cause.
Did you get any aches or pains afdterthe accident. If so you may be able to make a claim for personal injury as well as your car repair . See a doctor and lawyer without delay. |

Contrary to some of the answers that you've already received....
just because some one was hit in the rear.....does not mean that they don't have any negligence.
simply put....just because that other guy hit you....doesn't mean that he is solely at fault.
I don't know why people think that but it's obviously ignorance.
Anyway - there are 'DEFENSES TO NEGLIGENCE' that may make the vehicle IN FRONT partially, if not entirely, at fault.
One of those reasons is the reason you mentioned above....if you changed lanes and 'cut off the other driver's assured clear distance'...you can be found to have at least some negligence.
The fact that they are bring a claim against you speaks to that.
Since you don't have insurance....you are going to have to show up in court and prove your case.

Do you have a police report?
If you were full out rear ended (rear bumper, center) he doesn't have a leg to stand on. It doesn't matter if you did an illegal lane change, he still hit you.
He was driving too fast for conditions, failed to avoid an accident, etc...
If he clipped you on the side of the bumper, then its possible his argument will have a chance.
If you have a police report, you'll be able to prove this relatively easily. If you don't, make sure you have lots of pictures to show in yourr defense.

If he wants to sue, he surely can, the question is, will he prevail if he does?
If you had insurance, your agent would be representing you in this and trying to get you compensated for your damage. Did you make a lane change? If so he will probably prevail. Do you live in California? Law there basically says if you were driving without insurance, it's your fault no matter what.
Not very smart to drive without insurance. But...too late to change that now. Good luck. |

good luck. i was driving someone else's car and had a little fender bender, no cops involved. we traded insurance info with each other and the next day the person whose car i was driving said his insurance was expired. long story short, in oklahoma that's grounds for automatic license suspension. then the other person's insurance company sued me and i had to pay for those damages plus deal with the suspended license headache. hope your situation doesn't go this badly. |

You will have to go to court if he is suing you. It's stupid to not carry auto insurance, and that's your own fault. I would seek legal counsel either way - the person above me had some great points. |

Was there an accident report filed? Who got the ticket? Where I live, my ex was hit in my insured car, he didn't have a license but it was the fault of the other person, the other drivers insurance paid my insurance claim and paid the medical bills of my ex.
It should not matter if you had insurance or not, if you were in the left turn lane and stopped the other guys insurance should pay the damages to your vehicle.
In Arkansas there are 2 things pretty automatic as far as who's at fault. 1) rear ending someone 2) failure to yield on a left turn with accident.(even when the one making the left turn gets hit.) |
