i was rear ended by a lady and we both have geico and she even admitted that it was her fault at the scene but Geico is being ridiculous and keep insisting that i open a claim on my account if i want to get it fixed and the lady wont pick up her phone and geico says that they have made sevreal attempts to reach her. Why wont they just realize that she is not going to call back? They are holding me hostage for something i did not do? It has been 6 days since the accident.

Do as Geico is asking. They are trying to help you because the other lady won't respond to them. Use your own policy. When Geico pays out, they and their many lawyers will go after the woman and when they collect, any deductible you paid will be returned to you. |

You have to file a claim, regardless of who was at fault.
That is just how it goes.
Fault is only applies when it comes to your insurance company going after her insurance company to recoup costs.
In the case where you both have geico, it just means that her rates might go up, but they obviously are not going to be able to recover costs.
They are not holding you hostage, they are just telling you how the procedure works.
Edit: She need not respond, it does not matter, just submit your police report and process your claim so you can get your car fixed. |

This is completely normal. When you have 2 people insured by the same company, it's handled like any other claim. They must keep files separated to avoid a conflict of interest. Her adjuster handling her portion of the claim will not accept liability until they receive a statement from her, inspect her vehicle, etc.
Do what your asked to do. Have your repairs work off your own policy (has no effect on your premium) and get back on the road.
Your going to hear 'hire an attorney'....don't bother! Attorneys will not take cases with no bodily injury as there's no money in it for them. |
