Let your insurance worry. If they have produced false witnesses they can be charged with attempting to divert the cause of justice. The insuarance company will have had a copy of the Police report,if there is one |

thie is becoming all to coomon nowadays..
Simply, your insuramce company will tell you not to admit liabilty, as it could make your null and void, this magic independant witness is there way of trying to get out of it.
Ensure you have have all the forms filled in, also include if there were any witnesses at the scene at the time, therefore, as you have stated there wernt any, he would be making it up. His/her admission really means nothing, as you have no proof he said that. So whilst it stinks and very frustrating, you have to let your isurance firms sort it out, after all thats what we all pay over the odds for.
Just ensure all the forms state what he said, other persons around, CCTV, etc... log all this, this helps in the long run.
Dont worry, what often happens if theres not direct blame (not saying this in your case) they may go 50/50, but as far as i would states for future insurance quotes, it was a non-fault accident, to keep your premium to a minimum (as it wasnt your fault).
If you ever have a bad accident (lets hope you dont) non injury, then request the police, theu will breath test and your insurer will request a report from them, it will either help or incriminate you. If its ever injury no-matter how minor, the police must be called.
Hope this helps..a little, dont worry, take each step as it comes and give as much info as poss to the insurer to deal with the claim quickly.

If you have a police report, that's the only thing that matters. This is why this step is important. Additionally did you exchange insurance information at the time of the incident? Did you call the insurance company to start the claim process? It's very important that you continue to stick to the facts and fight this person's accusation.
My mother was hit in the rear by another driver who was able to convince the insurance companies that she somehow put her car in reverse at a red light and hit the car behind her. Since she didn't make any statements to the insurance company, she was found at fault and her insurance company paid for the repair to the other car, and she had to pay for damages out of her pocket. AND her insurance increased.

The important thing here is are there any witnesses in your favour? Otherwise, unless the other car hit you from behind, it could be your word against his. The witness that he produced? Is this kosher or is the witness manufactured? If so, then he is perverting the course of justice and simply fabricating the statement. You firmly need to maintain the original statement, stick to your version and see it through. But I would firmly debate the presence of the othert witness and what he is saying. If the matter involves motoring offences, you really need further advice on this. |

If it is minor damage small claims court, large amount lawsuit, best to sue for damages with a attorney and ask for attorney's fee |
