Sorry, I don't know what happens in these legal matters, it's all new to me. I'm not sure how to phrase this so please bare with me. So months ago I got into a minor car accident. While slowing to a stop at a red light, I rolled into the car in front of me a scratched their bumper. No damage was sustained to my car, and there were some scratches on the other person's car, mainly because of the screws of this plate that was on the front of my car.
The other person is suing me for injury, and I got a letter today saying that my insurance company's effort to resolve the injury claim was unsuccessful. It says I may receive legal documents from attorneys and if I do, to contact my insurance company to take appropriate action to protect my interests. I'm waiting for the letter from the attorney as of now.
I'm 18 and I'm worried that my parents will have to end up paying large sums of money because of this minor incident. I think I am registered under them for insurance since I do not myself own a car. I was driving my dad's.
I'm really worried. I'm scared I will have to go to court and my parents will have to pay thousands of hard-earned dollars. I really did not think the amount of impact I caused would be hard enough to cause injury. I know it's hard to say but I feel like it's one of those things to get money. Please explain this process to me, it would be greatly appreciated.
Since my insurance company couldn't settle it, does it mean it will go to court, or will there be more attempts to settle between my insurance company and the victim?

Your insurance company will defend you. Your parents insurance company will defend them. You MAY have to go to court, but meanwhile, the insurance company WILL try to keep settling this. Due to the fact that there is VERY little damage, it's highly unlikely that there are serious injuries - and that's probably the problem. The person you hit, is demanding an absurd amount of money.
So, they'll go to a judge. As long as the judgement is less than the coverage limit that your parents carry, the insurance company will pay any judgement. It's probably a good idea to tell your parents how worried you are, and sit down with them, and look at the coverage limits. |
