What happens if I get into a car accident when I'm not currently insured, but I'm not at fault.?

I got into a car accident and at the time of the accident I had a lapse in coverage due to a billing error. The driver of the other vehicle ran a light and nailed me in the intersection and I have a couple of witnesses, including a retired cop who saw everything and claim the other drive is a fault. I called the police but they did not show up since no one was injured in the accident. Will I get my damages taken care of by the other guys insurance company, even though at the time of the accident I was currently uninsured. I would appreciate it if any of your insurance industry professionals could help me out with my dilemma. Many Thanks!

I forgot to add that I live in Arizona and I am currently insured, but was not at the time of the accident.

Az. is a tort state (not a no fault state) so If you were not at fault in the accident, then the at fault drivers insurance has to pay for your damage. The fact that your insurance lapsed makes no difference.

It depends on the state i think. I know that since you were driving without insurance that you may get a ticket for that, but where i live i know that the other insurance would have to pick up the bill if it was his fault.

Globally:

-as you have not insurance at the time of accident you will get fine for driving an uninsured car - even if its not your fault
-other driver will get fine for his fault
-you have no insurance so this damages should be taken care by you
however police should provide you with an accident report
(not sure if you can repair your car without police accident report in Arizona)

Hope you did not have a big damage in your car :)
