My neighbor pulled out in reverse when i was in reverse and into the street. he hit my blazer on what would be the trunk door. The hit to his silverado was on the very corner of the long bed on the passenger side. his insurance claim 50/50. He said he was out in the street getting ready to turn at the street. (we both live on the corner)he wasnt!! he was only two back tires into the street? I told them if he had been in the street i would have hit him closer to his mid bed where the tires are and my hit would not have been to the trunk of my blazer. What can i do know?

NO police reports and no witnesses other then my ten year old niece and his brother who waved him down to stop. He said his brother waved him down to stop him. thats my other question why would he need to stop him if he was out in to the street??? his insurance didnt take him as a witness but didnt speak with my niece either. But all the neighbors know that they all drive really fast around our dead end street even when children are at play. and I feel he took blame when i told him didnt you see me? you guys akways pull out fast we've even had to honk at them to stop other times . I say i because my brothers and neighbor had this guy almost hit them too.

All insurance companies have adjusters to determine liablity. If you've opened the claim through the other guys insurance company then go into your agents office and request a claim opened through your insurance company. Ask them to do a liabliltiy decision. Advise the adjusters that you don't feel like the other insurance company reached a fair decision and explain to them why. Unfortunately in a 50/50 case each party pays for their own damage. If you honestly feel like this situation wasn't handled properly then you have every right to request another decision from the insurance company. Stick to your guns |

I hope you got your own insurance company involved. They should be the ones arguing with his insurance, not you. However in most cases where an accident occurs while both parties are backing it is declared 50/50 and each driver's insurance pays their share. |

This basically means that your insurance company pays for your car to be repaired and his insurance company pays for his car to be repaired. You will have to pay your collision deductible.
The best thing to do is make the claim with your company and let them hash it out with the other guys insurance company for you. With some luck they can subrogate and get your deductible back in a couple months.

50/50 means his insurance will only cover half the damage, if he told this to you id call them to make sure hes not trying to pull a fast one, i would call your insurance and see whats going on. |
