I was in a car accident on friday with a drunk driver. He is not listed on the insurance policy of the car he was driving. The owner of the car will likely say that she did not give him permission to drive. My car is 100% totaled. What happens? Do I pay the deductible? Am I going to have to go after him directly? (I'm sure he has no $$)? So how would that work?

Since you say you have a deductible, I'll assume you have collision coverage. File a claim with your insurance company. You'll have to pay a deductible. What will happen is they will subjugate the claim, meaning they will go after the at-fault party to reclaim their money and your deductible. |

If you have collision coverage your insurance company will pay to fix your car less your deductible. They will then sue anyone and everyone to recover their (and your) losses. If they get paid back, you will get your deductible amount back as well. If you were injured and have uninsured motorist coverage, it will pay up to the limits for your injuries. This coverage does not have a deductible.
None of this should make your insurance rate go up. |

In 1997, I was hit by a drunk, uninsured driver. My friend was killed. It was the 2nd time he killed someone while driving drunk. It took 4 years to get him in prison(17yrs,4mos.) My integra was totaled, and I ended up with $170,000 in medical bills. I never got paid a dime. Civil court will get you a judgment, but he won't pay it. Good luck. |

If I were you I would sue the person who "loaned" the car to him in the first place because it totaled the only car you have. If you have insurance you should have gotten a new car by the company or money to fix it completely and if that happens then I'd let it slide.Otherwise I'd sue the person that said I didn't loan the car to him person. Allstate covers all that and I'm not convincing you to buy it either so don't get me wrong. |
