Here in Australia the suspended licensed driver is automatically charged with traffic offences and if the car that that this person is driving is insured by this person then you claim against that insurance cover is claimable under third party. If you are injured then there is the registration third party insurance which is managed by the State the car is registered in and your injuries are covered under that insurance. then the suspended driver would face citations from the police for driving while suspended but the insurance would still have to pay. You can always sue if you have injuries, that's a separate case from all the suspended/not suspended stuff. |

Talk to your attorney to see what your legal rights are. If the owner was driving the car, you probably have a lawsuit. If the driver wasn't the owner, you most likely can sue the owner of the car. Either way, you have a law suit. |

That's a really sticky situation...Being as the driver has a suspended liscence and is against the law-driving..That person by the time this goes to court could be left holding the bag and fully responsible |
