We (me and my hubby) had an accident on Friday 13th Feb, where a car hit the back of my car - writing the two off! Bear in mind that my car was no old banger, but the damage sustained was so much that it wrote it off.
When the accident occurred, I was driving. I had to perform an emergency stop because an on-coming car came speeding and overtaking a parked van - it missed me by an inch! After about 6+ seconds, a Punto smashed into the back of us and didn't seem to have slowed down at all (distracted by the other car perhaps).
Almost straight away, I had pains in my neck and arms, yet my hubby was OK. It was only a few hours later when he started to have pains. So far we have both been suffering from Neck Pains (unable to rotate our necks), Pains in the arms, banging headaches, constant lower back pain. I have also been having Panic Attacks.
We have been to the Doctors and he diagnosed us both with Whiplash, and the insurance company assigned us legal representation (luckily I insist on having Legal Protection on the insurance).
My question is - how much are we likely to be paid out? Normally I hate people who claim needlessly, but we have both been suffering really badly. My hubby has had to have time off work (over a week so far as his job entails lots of lifting) and the car has been written off and we have gotten a lot less than it is worth.
We are not looking to claim needlessly, but are claiming for the injuries we are suffering with almost a week later. We know that we have to see an independent doctor in 5-6 weeks too.
What is the usual payout for this type of claim?

Only UK answers please as the laws differ in each country. Also, the 3-Point seatbelt doesn't activate when you press the breaks. the pre-tensioners activate under severe breaking and release when you have STOPPED. Hence the reason when someone is hit from behind when stopped, their seatbelts will move until the pre-tensioners activate again.
Please answer the question, and if you don't have an answer, take your 2 pennies worth and shove it up your ar*e! You weren't in the crash!

As far as how much you will get paid out? That depends on your specific situation.
Some get tens of thousands. Some get nothing. There is no "usual" payout.
You are not entitled to anything besides repairs to your car, and medical bills.
So, figure out how much your bills are, and that's what you are actually entitled to.
Also, the vehicle was written off for what it was worth. You might have valued it higher, but that doesn't make it worth that much. That's the way it goes. Lots of people are surprised to find out how much their car is actually worth.
So far, you're not in pain and suffering. And one week of work missed, is barely lost compensation. That's how much money missed? $1000? less? Whiplash will go away. It's not like you've been permanently injured or disabled.
I'd figure about $2000-5000 on top of what you're entitled, but that's about it. |

all insurance company's got wise to the whiplash claims with the indrodution of three wayseat belts witch will have activated as soon as you appliedd the breaks to hold you inpositionn and as all modern car are fitted with head restrains deisnged to prevent such injuries i think you be lucky to get any personal injury claim |
