on the 24th of december i had a accident (not serious at all) whilst delievring it was my fault. then i told my insurance company, they said they cannot deal with it as i was delievring at the time and i was not insured to deliever. they told me they cannot basically do anything. so i rang the person up and said can we deal with it privately, he said OK. then he still went ahead through insurance i figured this out myself as he gave me a number to ring and find out how much it will cost so i did and asked them what is the purpose of their service and they said
'we deal with accident claims and fix cars whcih insurance companies tell us' so i was a little bit comfused.. cause he said he would deal with it privately to me....
and his car is currently getting fixed.. it has been a while now and neither has he or the insurance company has rang me...
i am really worried, i don't know what to do... where does this leave me... shall i ring the man up again...?

i asked my sister but she is really ignorant and doesn't like to talk to me... i have no dad there for me or mum or anyone else so please help!!!

you have no case for a claim. you were using the car for business use (delivering) but were not insured for it.

I'm afraid that you will be responsible for the repairs to the car of the person you hit. Even though he has agreed to settle the matter privately, it is his right to let his insurance company deal with it if he chooses. His insurance will take action against you to reclaim their costs. If you were delivering and you were not covered for delivery then you are really stuffed. Your insurance company are completely within their rights to refuse to deal with the claim as you did not have the correct level of business cover on your policy. |

sorry,but you are in the pooh. you were not insured for hire or reward,so your insurance will not pay out. it is down to the other drivers decency as to whether he pays you or not.however if you look at it from his side, why pay insurance and pay for repairs as well. sorry,i don't think you stand a chance |

Right ok, well this is tricky because your insurance is invalid due to you delivering items.
So this driver cannot claim against your insurance yet he's trying to.
The situation now is, when he finds out he won't get any money through the insurance then the police will be called and you could be charged with criminal damage or reckless driving.
I can't see him going this far if you have agreed to pay. You are fully entitled to get at least two bodywork quotes from this guy, and your insurance would ask him for these as well.
I would phone him up, tell him you've received the paperwork from his insurance and tell him where you stand with your own insurance. He will have no choice but to settle with you, but you need to get the two quotes from him in case he's trying to rip you off.
The other option is to settle the claim through the company who sent you the letters, they may even do a payment plan.

Your Insurers aren't going to help you!! You were driving on a social domestic & pleasure cover, not a going to work one! SOOOOO many people drive to and from work in their cars, not realising they are NOT insured to do so. |
