What should I do?

Hi guys,

What should I do when my friend rent my car to others? I rented my car to my friend and it was rented to another third party without my acknoledgement? What offence is she committing? Please help...

Hi guys,

Thanks for all the replies. The car is back with me now. Though I am not a licensed car rental agent, I rented out my car to this person. She in addition rented it out to another third party. All of us were charged in court and my license was revoked for a year. I accept my punishment and am now looking ways to sue her for compensation. We even drafted, endorsed and signed a contract in the presence of a lawyer. The contract does not state that I allowed or prohibit my friend to rent out the car to a third party. So is it my fault then who left out this term?

Unless you're a garage or other business, you can't legally "rent" a car to your friend in the first place, and your own auto insurance policy excludes coverage if something happens if you do

If the original action (the renting) was not legal, I don't believe you can enter into a legally binding contract regarding that action in the first place (eg, you can't try to enforce a contract regarding theft, or drug dealing). You can always try small claims, but since without the original incorrect act (yours) none of the resulting issues would have arisen, I'm not sure how far you'd get.

And I can't believe a lawyer just sat there and didn't advise any of you against this. Sheesh!

That constitutes unauthorized use of a motor vehicle by the third party. That might apply to your "friend" as well. Check with your insurance agent and/or the police.

If no damage was done then I would say just drop the friend. If there was damage then they broke your verbal contract and you could sue but I don't think there is any legal laws against this, unless they still have your car you could report it stolen.

In some cases..a verbal contract between two parties considered valid without witnesses. Take this friend to a small claim court and sue her for a primitive damage meaning a conditions before and afterward..if any damages to the vehicle she's reliable for compensation..after you loan it to her..do you any pictures of the vehicle before you loan it out..There's a different between rented and loan it...so in a small claim court make sure you phrase it correctly...

if she is really ur FRIEND talk to her openly as she is not supposed to rent it to 3rd party it is only for ur persoanl/offical use.if she donot come to terms Sue her only if u have a written agrement with a clause "she will not rent to 3rd party"

First of all if you truly "rented" the car, then you probably violated the terms of your insurance policy and if it were wrecked your insurance policy will not pay. I would get the car back and drop the matter entirely becasue you are not authorized to "rent" cars. Most states require special insurance for rental car companies. It is different if you "loaned" the car, but in any event pursuing the third party and the second party is just going to be a hassle. If you got your car back in the condition it was in when you "rented" it, consider yourself lucky and lesson learned.

Unless you are a commercial business with everything in place to rent cars, you can't rent a car to a friend, and if you do your insurance wouldn't cover it, so if there is an offense committed, you are the one committing it.

Your first friend who 'rented' also has no right to rent out any vehicle, let alone one not belonging to her.

Get your vehicle back, and quit renting it out.
