What should I do, had a major accident?

ok so my car was hit by a drunk driver who fled the scene but was caught by the cops.
My car is totally damaged but that other guy does not have insurance and I only have Liability insurance (AAA) which does not cover the whole cost of my vehicle (but my insurance is welling to pay half of it)..

So my question is what should I do? Is there any way I can get the full cost of my vehicle?

Ok I should have also added that I am covered under "Uninsured Motorist" and that's why my insurance is paying me half of the value...

But no it was not my fault cause my car was parked in the parking lot.

And he also hit 2 more cars while running away...

If the other person did not have insurance, then you may be able to file a uninsured motorist claim. You will need to ask your agent or adjuster about that.

I don't know what state you are in or what the specifics of your policy are or how the accident happened, but based on the very little information provided - I would suspect that your insurance company is already handling as an uninsured motorist claim.

Liability coverage pays for the other guy - not you.

Now, if they are only paying 50% of the value of your car, I suspect that means they have determined the other driver was 50% at fault and you were 50% at fault. Uninsured motorist coverage would only pay for the other guys share. Since you do not have collision coverage, you would have to pay out of pocket for your 50% share.

You probably should follow up with the adjuster handling your claim. Since they have all the information I don't have, they would be better able to answer your question.

No. When you get liability insurance you are basically saying " i understand that if i crash my car I will not get money for my car and i am ok with that"- what if the accident had been your fault? You CHOOSE that coverage.

Since the other party does not have insurance either you only way to move foward is to sue them personally.... but lets be realistic. If they dont have money for insurance... do you really think they have the money to pay you when you sue them?

Wow. That is unfair.

I would talk to a lawyer for sure! Find out if you can take the insurance money and then sue the driver for the other half.

Also... get some real insurance!!!

As a lawyer for some advise it may cost you a visit but it just maybe worth your time there may be something within the law that can help you!

Sue the guy. Chances are he doesn't have anything, but thats the only option you really have. Your insurance is being exceptionally nice by paying for half the car, they don't have to give you a penny since liability only pays for someone else's car if you hit them. Go talk to a lawyer, and see what they say. It is a gamble, because if they have nothing, you can't get anything from them.

i believe that you can still take him to court first of all because he was drunk and second of all because hes not suppose to be driving without insurance............he have to pay out of his pocket.

Sue him without using a lawyer (they would take most of any settlement). I hope you are able to get a fair judgment against that loser.

Sue the other guy who hit you. And get a lien against him and his house so he can't get credit to buy anything in his name.

Look up lawyers/attorneys in your area...and check for 1) freee consult and 2) motor vehicle accident. be sure you have a copy of the police report/accident report that you can fax to the atty asap.
