You should get the other person's insurance information for sure. They are at fault and their company should pay for your damages.

I've been through this situation a few times. In my state the law says the person doing the rearending is always at fault. They have to prove themselves otherwise. You should contact your insurance company immediately. It is best to call the police and make a report. Documentation is VERY important at all times. Immediatly after the accident write EVERYTHING down and save it. Everything from what the weather was like, how fast you were driving, the direction the vehicles were traveling, EVERY detail. It may take several years for a lawsuit to come about. There are statue of limitations in my state it's 3 years. If it comes to a lawsuit the lawyers will question everything. Never trust anyone. You never know what will happen in the future. Don't be the nice gut. They may try to sue you for damages or injuries later on. Even if they claim nothing at the time. Report to your insurance company and they will handle everything for you. That's what insurance is for. If you do not have insurance. Try to amicably exchange information with the other driver. Make a police report and then decide how much your damages are and if you need to pursue the issue further.

if it has not already happened, try to carry a camera in your car so you can photograph the situation. These will help when you need insurance.
Notify the police right away if it is serious at all
Notify your insurance company as quickly as you can.
Get name, address, license number, license plate number of the other driver, and jot down names of any people who may have witnessed the accident.

ok first thing get the plate # just incase they decide to run then call the police as much as i hate to say that. Then there is a report saying you are not at fault or anything. While you are waiting for the police get the drivers information, insurance company policy numbers , phone number.. i mean everything you can squeez out of them get it. Drivers licence # if they'll give it to you. Take pictures.. .Get witness phone #s. then when the police get there let them write up the report.. also call your insurance agency while waiting .. cause lord knows it will take police forever to get there., and ask them if there is any other info you need to get.

You should have gotten all the info from the other driver & called the police...at the scene...then, call your insurance company.
If you left the scene with no info from the other driver, you are screwed...

get the other persons insurance info, go to a doctor to get checked out, even if you feel OK, and if there are any damages to yourself, then you need to contact a lawyer.
