Me and my mom was in a car accident on Monday and her car is totalled and she only has liabiltiy on her insurance and i have whiplash my mom was driving and there was black ice on the freeway and no other car was in the accident and there was no warning about the black ice at all and it wasn't even snowing at all! We went to the emergency room on the day it happened and the doctor said there was nothing broken! Is there anyway that i can sue or get money without hurting my mom's insurance? I will probly be needing Physical Therapy! I am in so much pain and im traumatized so bad, i dont wanna go nowhere or anything...i hate being in the car with anybody! So please tell me if you know of anyway for me to get money without hurting my mom in anyway?...
and btw she slightly has whiplash also. Thank you for sharing your knowledge in advance! :-D Additional Details And the thing is i dont have any insurence...Whiplash is way worse the what people think when you hear the word....i can be permanately messed up if not treated rite and i dont have a job...so i have no way of paying for medical bills! It's good that you went to emergency immediately. Were you taken from the scene of the accident in an ambulance and if so did they place a neck brace on you?
The documentation from the accident will be covered by the police report however, the ambulance drivers responding at the scene provide another avenue of documentation to back up a claim.
Your mother's insurance has a minimum amount generally set by the state for third party liability. In Canada for example the mini mun amount is $2,000,000 with the majority of insured drivers paying a little extra on their premium to hold $3,000,000 in third party liability insurance. Find out how much third party liability insurance your mother is holding and then see your family physician ASAP telling himher how your feeling.
Whip lass is tricky, I hope the ambulance attendants gave you a collar, and if not you should probably consider asking your physician if owning to the pain you shouldn't be wearing one now!

Who would you sue? Your mom was techically at fault and no other drivers were involved.
She only had liability and that is a risk she took.
Whiplash is not as serious as one thinks, although the symptoms are variable. It is largely influenced by psycholosocial perceptions. The fact is, the vast majority of whiplash cases will go away on their own...even without physical therapy...of those that persist after 6 weeks, still only a small percentage become chronic.
There are some interesting society influences on the perception of whiplash...namely:
1. It exists primariy in cultures where there is motivation for litigation...it is rare in countries where you cannot sue someone
2. Fear and anxiety are LAREGLY associated with whiplash.
3. Adverstising by lawyers, chiropractors, etc only perpetuate the myth that whiplash is a "permanent" and "chronic" condition.
4. Truth is, there is NO direct cause/effect relationship between motor vehicle accidents and cervical disc degneration.
Here is the good news:
1. Aside from advice to remain active within your pain tolerance, there is really no evidence that formal treatment of any kind will be more beneficial than no treatment in the first 6 weeks of a spine injury.
2. Less than 15% of cases that persist after 6 weeks will become chronic
3. Reducing fear and anxiety may be all that is needed in the treatment of whiplash.
4. Of cases that persist after the first 4-6 weeks, the vast majority can be treated with specifc self directed exercises that can be done at home when directed by a physical therapist...often only requiring a few short visits (usually about 6)...certainly affordable even without insurance.
Relax, stay active within your tolerance. Seek medical attention if you have pain that radiates to both hands, is accompained by diffused motor weakness and numbness or if you are having difficulty talking, swallowing, double vision or are blacking out |

your mom should carry med pay or PIP in most states. this will help with the bills. Also you should be able to get a settlement under her bodily injury coverage as she was at fault for the loss. The insurance adjuster will assist you with all this |

Firstly, READ WHAT YOU WROTE.
You want to SUE YOUR MOM?
You were involved in a solo car crash where your mother was 100% at fault. If you are a minor or are a resident relative (live in the same household and blood relation), then your policy will prohibit you from making a claim against your mother's policy. If you are an adult, living outside of your parents house, you may be able to file a claim against your mother's policy under "bodily injury".
You need to ask your mother if she has MEDPAY coverage on her policy. If she does, then you may be covered under medpay.
Next, see a doctor. Unless you are a healthcare professional, inexperienced self diagnosis is probably not the best idea. "Whiplash" is typically just muscle strain caused by hyperextension of the neck. It may not be symptomatic until a few hours or a few days after the accident. It may have side symptoms of nausea, headaches, and obviously neck pain/stiffness. You may find that it will resolve on its own after a couple of weeks. You can help alleviate the neck pain and stiffness with Aleve or naproxen which is a pain reliever and anti-inflammatory.
If you don't have insurance, and are strapped for cash, you could try to go to one of those walk-in clinics. You will probably be charged about $80 for your visit. They will look at your neck and prescribe rest, ice, and Tylenol or Aleve. X-rays are not typically necessary for soft tissue injuries like you describe, as they will not show anything. |

Your recovery and your mom's are the most important parts of this drama. ER fees, physical therapy, follow-up MD visits, medications, and appliances (cane, walker etc) have to be paid.
Your mom was driving so she is responsible. She can pay out of her pocket or through the insurance company.
Use the insurance policy for the reason she has it...to cover expenses in case of a mishap. She has been paying into insurance for many years. Now is the time to collect. |
