my husband and i were in a very bad head on collision this sunday, not typing with a capital because my wrist is sprained and i'm typing with one hand. i was rushed off to the hospital and my husband drove to the er to get checked out. the driver came into our lane, crossed a double yellow line, and collided with us at about 40 while we too were going roughly 40, there were no skid marks on either end, neither of us had time to stop. so he is at fault. however, we found out that the guy who hit us with his bmw 750 does not have insurance, it expired on jan 29 and we got hit on feb 8. we believe he is in high school and possibly was driving daddy or mommy's car. he even gave the police a disconnected number. our car is totaled, there is no repairing it, there is no front end left. now that i know he has no insurance, i'm worried that we are going to get only $3000 or so to pay for our car that was in great condition. i feel like if we are going to get anything worth anything we are going to have to go into debt for it. on top of it, our pip will only cover 10,000 dollars and i know that the er visit alone probably used that all up so we are going to be paying medical expenses out of our pocket. luckily we own the car rightly so we don't have to use some of the money they give us to pay it off.

Well, what you SHOULD get from the insurance company is the value to replace the car. So KBB shows a 2000 ZX3 as $5485 from the dealer and a 2004 at $7030. I have no idea what year your car was, other than it's between 2000 and 2004. (Also, I forgot to include options like power windows, so you can add about $50-100 depending on what options it had.) And even in the accident pictures you can tell that what's left of the car is in excellent condition.
But I think you'll be just fine in getting a replacement. There are plenty of nice used cars to be had for under $10K.
As for medical, that's a whole other matter. If you want more than your insurance offers, you probably have to contact a lawyer. Just because the kid doesn't have insurance doesn't mean he's off the hook. He and his parents could be in a lot of trouble. |

They will "low ball" you. You can challenge their estimate by providing about four ads advertising comparable cars to them. They need to be comparable in mileage, same age, make and model, and accessories. If you've done any major ($500) work in the last six months on your previous vehicle include receipts for that too. |

If he was driving a BMW 750 mommy and daddy probably have plenty of money. If he is under 18 they are financially responsible and you can sue them them for all damage, medical bills, and pain and suffering. |

My fiance was in an accident last month the girl rear ended him and the trunk was in the back seat. The insurance company will give you the littlest possible that they can give. You might have to put up a fight to get the amount you want and most of the time they will give it. Hope this helps! |
