My insurer telephoned me to inform me that I had bounced a payment and that the company would move to cancel my insurance if I didn't get it paid soon. I told him I'd be in within a week and he told me that I would be covered under Bailey's coverage for a limited time. Long story short I was pulled over during the week by Bylaw Enforcement and had forgotten my wallet at home so was charged with failing to produce, driving with no insurance and summoned to court. I went in the next business day, changed the coverage on my insurance to 'work' and paid 1/2 up front. Now the insurance company tells me that I was not insured at the time of the ticket and I am facing a massive fine when I thought I was still insured. I'm told that they are required to send me a registered letter notifying me of the cancellation, is this true? Do I have a legal leg to stand on? Court in a week, please advise... thx.

In almost all provinces with private auto insurance (government run insurance works differently) the insurer has to send you a REGISTERED letter to your last known address informing you that the policy with a cancellation date two weeks after the date of the letter (so if the date of the letter was the 1st the cancellation date would be the 15th). They do not have to prove that you received the letter, they just have to show it was sent. So ask them for a copy of the letter and see what the effective date of the cancellation was to see if you were truly not covered that day.
You stated you went in and changed the coverage to 'work'. Is this the same policy as you had before, or was this a new policy. If this is the same policy then it shows the policy is still in force, or else they would not be performing changes on a policy that was canceled. |

Generally all the company has to do is send an ordinary letter (not registered) to you at the address on the policy. If you take your insurance ID to court with you, you might get off even if it wasn't in force when you got stopped. |
