I was hit by a gentleman. He ran a red light, and was cited for failure to yeild, and the accident report stated that he was at fualt. He gave insurance at the time, but now that I have called his insurance. They claim he has no insurance. I have a double fracture on my leg, had surgury, and spent 4 days in the hospital. I am also out of work for 12 weeks. I am assuming that I will need to pursue this in civil court. Any advice would be nice. Thank You.

If you have insurance - you can pursue your uninsured motorist coverage. You should do this immediatetly - contact your insurance company and provide all the necessary information. You could pursue this in civil court against the other party - however if he has no insurance - he most likely has no assets, so what would you get from pursuing it in small claims court? You can atleast be compensated from your own policy and they will determine if they are able to recover from the other party, and if so, they will pursue him in subrogation. |

Your insurance policy should cover un/underinsured motorists. call your company and ask about it. |

you need to call your own insurance company thats their job to pursue the guy small claims only allows you so much money and well it wont even cover your surgery |

you assume right.. about all you can do is small claims .. however.. just becasue you win the case does not mean the man will pay up. |

Your collision coverage will pay for your car, if you have UM that should cover the medical. |

as well as the local police dept - since he claimed he had insurance.

You more than likely have coverage for uninsured or under insured motorists. Since you have this coverage, your insurance company is responsible to pay your accident-related expenses up to the limits of the policy. Going after the guy with no insurance is their problem, not yours. You already have enough to worry about.
Call your agent and get the ball rolling. We all know that insurance companies just love to collect money but they hate to pay it out. Don't waste any time, get moving.
If your insurance company tries to play hard ball with you be prepared to contact either an attorney or your state insurance commissioner.
REMEMBER to NEVER make a pre-mature "settlement" with an insurance company. They are always happy to give you a less-than-adequate offer that will leave you in financial ruins while they walk away from the claim laughing. Don't be tempted to sign away your rights. |

Im hoping you have auto insurance. If so, your insurance company will pick up the cost, will pay for your car and your hospital bills, and also will go after the other person-the insurance company will go after him and sue him to get their money back. You probably could sue him as well.
Also, i would try to get in contact with the police officer who investigated the accident, to let him know that the person LIED about having insurance. That way when he goes to court to pay his ticket for causing the accident the Judge will hopefully find out he had none and nail him for that.
Best thing to do of course since you were physically injured is to contact an attorney ASAP before you do anything else.

im in the sam situation as u expect i didnt get hurt but he said he dad insurance but the company said he dosent so now i have to pay a 500 dollar deductable and hope that the guy pays them back so i can get my 500 back but good luck ill let u know how mine goes |
