I was in a car accident yesterday, but it wasn't my fault. I was stopped and got rear ended and then pushed into another car. I didn't get any citations and the blame was put on the guy in front of me. I know that its his fault and his insurance will pay, but Im having problems with my insurance. They said that my insurance was canceled two months. I know there were some problems with my payments, buy I have a notice from the insurance telling me how much I owed and that they would automatically take it out of my account. They just took the money out, but now are saying Im not covered. What should I do if they stick with that my insurance was canceled? And why would they have been taking money from me if my account was canceled? This is my first accident and I don't really know how the whole insurance things works. Any advice would be very helpful!

First of all, the accident is not the fault of the person that was in front of you. The person that HIT you is at fault.....
Anyway, you need to check with your agent to see why money has been drafted from your account and why you don't have insurance. There's really not much we can help you with. You'll need to call your agent or insurance broker to find out. |

Your insurance is cancelled ONLY if you have received a cancellation notice from the insurance company. The notice has to contain a date of cancellation and a reason for the cancellation. If the cancellation is for non-payment of premiums, then the cancellation must contain a date (and $ amount) in which you have (grace period) time to pay in order to reinstate the policy. IF you received a cancellation with or without the stated information AND you ignored the cancellation notice. Then, if fact, your insurance policy is non-existent. If the Insurance Company automatically withdrew money from your account, then I suspect that money was for past due premiums. In which case, the accident is only insured if it occurred within the paid-up time limit of the policy. |
