What usually happens to an uninsured driver if they have a car accident?
|
I understand insurance is a must-have if you own a car in case your car gets damaged, as repairs can be costly. If you have an accident you would claim from the other party.
However, if you're involved in an accident and you're not insured, what usually happens? Do you get arrested and points on your license? Do you pay the other party's damages all out of your own pocket?
I know to many people this will seem like a daft question, but I don't drive and I've always wondered this. Additional Details I live in the UK.

Well, you would be arrested and charged with driving without valid insurance in the UK normally with a IN10 planted on your licence if you had one, which would make it very difficult for you to get insurance in the future as insurers take a dim view on those who drive without valid insurance.
Furthermore, in regards to damages it depends on what the court decides and whether they deem yourself to be liable and able to pay for the damages, you would also likely be looking at being banned from driving or quite possibly a custodial sentence again dependent on the court. |

To use a colloquial term " you get the **** sued off you" by the other person and their insurers.
Someone involved in a collision with no insurance is very likely to find themselves being prosecuted by police for no insurance which will also likely result in being disqualified from driving and a few hundred to even thousand pound fines. |

You would be taken to court, recieve a heavy fine and most likely a ban for at least 6 months, and probably be taken to court again by the insured driver / insurance company to recover his costs.

You would get taken to court, points on your licence and a hefty fine. Normally the other parties insurers will cover the damage. |

You would be done for driving without insurance, and usually not having you vehicle road taxed as you need a valid certificate of insurance in order to road tax your car.
You would get a fine, points and possibly a ban, depending on the seriousness of the accident- a custodial sentance.
People who do not insure their cars are selfish and put the price up for the rest of us. |

You will be taken to court and get 6- 8 points on your licence, plus a large fine. In addition, your car can be seized and crushed. The other party's insurance will fix his car if he's fully comprehensively insured, otherwise he will need to either apply to a fund which exists for this sort of thing or sue you. |

I think you need to appreciate that insurance isn't a 'must have' because of the cost of damage to your car, it is a 'must have' incase you cause damage to someone else. If you knock someone over, through your own fault, and they finish up in a wheelchair for the rest of their lives, how are you going to afford to pay their costs for as long as they live - probably millions of pounds?
The answer is by being insured - that's why insurance is a legal requirement - nothing to do with damage to your vehicle, unless it was the other person's fault.
So - that being the case, perhaps you can understand that just being caught with no insurance, let alone actually having an accident, is a very serious offence. Points, heavy fine, gaol - they're all possibilities. |

i work for an insurance broker. firstly the driver will be prosecuted by the police. if the driver was driving a car which is insured but not for them, then the insurance co will pay for damage to a third party. they have to by law. if there is no insurance at all on the car, then there is a pot that all insurers pay into to cover this type of think. the money for third party repairs will come out of that pot. providing the police have had a successful prosecution of the driver, the insurers will be able to claim all their costs back from that driver via the courts. as you can imagine, this can run into thousands and thousands. hope this helps. |

It all depends. Some give you a ticket, which could be a $1000 or more. You go to court and if you purchase insurance before you get that and show proof they might reduce the fine. Some will take you to jail. |
