i wanna buy this car from this guy , but the bank still has his title .
he paid off the loan hes just waiting to get it back.
we agreed to file for a duplicate title , can you tell what steps do we have to take and how long is it gonna take till the car is legally mine?
(that guy is a friend of mine)

You/your friend don't want or need a duplicate title. When the other guy gets the lien release to his title, then and only then can he legally transfer the car to you or to anyone else. You should wait.... |

Why? The bank will be sending the title with a lien release. If he (not you, it isn't yours yet) applies for a duplicate lost title, they will send one with the bank listed as owner, and you'd have to go to the bank anyway.
Just wait until the payment to the bank clears and they give him the title, then do the transfer. He can call the bank and ask about it, that might speed things up. |

In California:
It's common for a new title to take 5-6 weeks.
Seller gets the car smogged (good for 90 days)
Go to the DMV or AAA Auto Club both buyer and seller together.
Fill out REG 227 Duplicate for Title. Seller signs front, Buyer signs back.
Fill out REG 262 Transfer and Reassignment form. Fill in Odometer disclosure and seller/buyer sign the bill of sale section.
The DMV/AAA will "RDF" for lien release. (both buyer and seller names are listed in the data bank, until new title is turned in)
Seller should sign a Release of Liability...especially since the transfer is incomplete at this point.
Seller mails the new title when he gets it from the bank. (sign the front first) (send it certified mail) or hand it to you since you're friends.
Buyer returns to DMV or AAA to complete the transfer. Seller does not need to be present to complete the transfer. |
