Good luck. You have uninsured motorist coverage for situations like this. It happened to me and the person that hit me just disappeared. I had full coverage. The insurance company gave me $600.00 because that is what value they assigned to my 68 Camaro. My insurance company also paid my medical expenses. You should contact your insurance company and ask them how they want to handle this. Or you can call the State Insurance Commissioner and ask how it should be handled according to the laws in your state. |

Not much. He/she is probably already back over the border and will never be found. That's why you have uninsured motorist coverage. It's also one reason why car insurance is so high in border states like CA, AZ, NM, and TX. |

Well, the odds are you have insurance, right? If not, then you are breaking the law too. If you have insurance, most policies cover accidents with uninsured motorists. You should always carry a policy with maximum coverage. Most of the immigrants I see (I can only assume some are illegal, others might have temporary permits to be here) walk , or ride their bikes to work, they can't afford a car, so if you got into an accident with that rare illegal alien that can afford a car and pay for gas, etc, then it was just bad luck dude. |

That's why you carry uninsured driver insurance. The police are supposed to impound the car if they are uninsured, if they didnt drive off that is.
Other than that, there isnt anything you can do. |

If you go throught the police they will take action, although tbh i cant see you getting any compensation, seeing as i would assume this person has very little money, so unfortunately you will probably be looking at a claim on your own insurance. you can always contact your own Solicitor and ask him what course of action to take!

this happened to me with a restored 1960 t-bird parked in my drive way...
the police refused to do anything even tho he admitted he was in the country illegally..
i was lucky and had uninsured motorist coverage that helped me..
he was driving a almost new explorer.. but had no insurance..
his car was towed and it turned out he had never made a payment after driving it off the dealers lot..
bank of America loves giving loans to illegals.
for homes as well as cars

As for the damage and any injuries to yourself or your passengers, your vehicle insurance should cover the costs since the other party was uninsured (it will fall under the "uninsured motorists" aspect of your insurance policy). I don't think that insurance companies can hold this sort of claim against you when deciding whether or not to raise your rates (like they can if you were at fault). However, as far as suing or having the person cited, etc., the only thing I think that can happen is: the police cite the person for the accident and then arrest him or her for being an illegal and he or she then goes before the INS Bureau for a deportation decision. I'm not sure you have any other legal recourse. |
