Who's Auto Insurance takes priority?

Assuming that both you and your friend have car insurance and you let your friend drive your car who causes an accident, who's insurance takes priority? Your insurance because you let him drive your car? Or your friend's insurance because he drove the car? Thanks

Generally speaking, the insurance on the car is primary, your friends insurance is secondary and covers an excess damage your policy doesn't. For example, if your property damage limits are $15,000 but the damage caused to a 3rd party is $25,000, your policy pays the limits of the $15K and the drivers policy will pay the difference UP TO the limit on that policy.

Your insurance would be primary, the other driver's would be secondary. Every policy has different stipulations so you should read yours. But at face value, as long as there aren't any provisions about certain drivers being excluded from coverage on your policy, anyone driving your car would be eligible for your coverage if there were an accident. If your policy 1) denies coverage to you for some reason or 2) doesn't carry enough coverage to fund the entire accident, then the driver's policy should kick in to cover 1) all of the accident costs or 2) what's left over that your policy did not cover.
Again, every policy is different but what I've outlined above is pretty standard auto insurance industry practice. |

It would be your insurance that takes car of it because you let him drive it. Now your insurance company and come back and sue his company because he was at fault, I think this is how they do it. He will see a difference in his insurance policy too going up. |
