Who's Car Insurance Would Handle the Accident?

My sister has been driving my mother's car (Loan, registration, insurance in my mother's name) Occasionally she allows her boyfriend to drive the car, although my mother has stated on numerous occasions that she does not want him driving that car.
He was in an accident on Friday and claims the car is totaled. He claims that he called the police and filed a report, it can be picked up on Tuesday. He also claims that his insurance is covering the accident. My problem is, the car is insured in my mother's name, so he is not allowed to do this, correct?

Also, even though my mother was not involved in the accident, can she still call the police and get a copy of the report? After all, the car is in her name.

Please enlighten me, I'm trying to figure this all out.

It depends on his type of policy- if it will follow him when he drove his girlfriends mother's car. Usually, certain requirements must be met for your insurance to cover you when driving someone else's car. If his policy allows this, then his insurance will cover at least part of the claim if not all.

It also depends on whether he is an excluded driver for that vehicle.

I'm pretty sure the drivers insurance will cover it' If insurance always follows the car, why must I have insurance when test driving or renting a car.

In CA insurance follows the driver first.
That means his insurance would take presidence.
IF he didnt have insurance or did't file a cliam or disappeared, your mom's insurance would have to cover it.
You can get a free consultation form a lawyer for something like that if you needed to. I was in an accident while I didn't have insurance and that's what the lawyer told me.

Her car, her name, her insurance. It will cover the accident. And police reports are a public record, anybody can look at them if they want to. So yes, she can get a copy.

yes- as the owner she is able to get a police report.

His insurance should not be covering the vehicle. Insurance follows the CAR.. not the driver. I think he is lying or misinformed about this- the second they see the vehicle he is driving isnt on their policy- they are going to deny it.

YOu need to file a claim through your mothers carrier and pray for the best (they have every right to deny as well since he uses the vehicle and is not listed on the policy) Notify them ASAP so they can take care of this.

If he is insured, you probably need not worry. You will probably never know how much each one paid

First, Yes your mother can obtain a copy of the police report

Secondly, I highly doubt the boyfriend's insurance is covering the accident.

Insurance follows the vehicle, not the driver. Your mother will have to make the claim on her auto policy. Seeing though as the boyfriend has driven the vehicle many of times without permission, its possible that her carrier may deny the claim.

If that is the case, then the boyfriend can try to make the claim on his auto policy. However, again there is no guarantee of coverage. It depends on the conditions of the policy. The mother's vehicle would have to qualify as a temporary substitute vehicle.

Finally, was the boyfriend at fault for the accident? If not, and there is an at fault party w/ valid insurance, make the claim with that company to avoid the above mess!
