well my gut instinct is...if they're in the right hand lane....why are they turning left?! they should be going towards the inner roundabout and you should have been on the outer roundabout.
If you were in your lane, they should have been concious of their large vehicle and let you go, so if you were driving in the correct lane, i would support your side.
just remember, treat every other driver on the road as if their an idiot :) |

You're saying that this small van was making a left turn from the right lane. Well, is it legal for them to do that? If not, then they are clearly in the wrong, and the law should be on your side. I think the van driver just screwed up and didn't want to admit it. |

Yes it is his fault, he was in the wrong lane.
If what he said was true and he needed to use the right hand lane then because of a large vehicle, he should have either stayed in the middle of both lanes, or waited for you to go first. |

I would say that if there were no road markings then you had the right to go straight on as you were not indicating to turn left, the other driver could just have easily turned right from the lane he was in providing that he was so indicating. Being a slower tipper van which was possibly a long wheel base type. It would have made sense for him to stay in the left hand lane due to the other traffic being quicker than him anyway. I hope you were able to take some pictures of the area that it happened it will help prove your case. I would say that he was certainly at fault, but that you both still had a duty of care when on the roundabout to look out for the other as not everyone gets into the correct lane as this has shown his mistake. why he should feel he needs more room in his van I cannot answer because it is not considered to be that big unlike a lorry or HGV. He was basically overtaking you at the time of the incident an ran into you by cutting into your lane, don't worry to much let the insurance sort it out they are used to this type of problem. |

It depends - if you were in the left hand lane & going straight on, did you keep left enough whilst on the roundabout to allow a vehicle to your right to use the lane to your right?
If he was in the right hand lane turning left, then you are certainly not at fault regardless of what he says. |
